Administrative procedures

This section should provide a description of the general administrative procedures used by the operating organization to ensure the safe management of the plant. The processes to develop, approve, revise and implement plant procedures should be described. A list of the main plant administrative procedures should be provided, together with a brief description of their objective and contents.

Biomedical research and, in particular, clinical trials are very complex and well regulated. Administrative procedures have two objectives to provide help in obtaining correct and unambiguous results, and to prove that experiments were performed as described, according to high scientific and ethical standards, and therefore to increase confidence in the conclusions obtained. Administrative procedures also involve various controls (inside and outside the institute performing the study). 

Quality assurance/quality control should be a standard part of research practice, and this includes sample handling. Since it is inevitable that several individuals and often several laboratories will collaborate, strict adherence to SOP is essential. Inappropriate handling of the samples could endanger the result of the whole project. It also helps the technical personnel to avoid misunderstanding or misinterpretation. 

Labeling, retrieval, and storage of samples should be regulated in detail, just as sample flow. Equipment should be maintained and calibrated regularly the personnel operating them should be trained properly. Note that these not just have to be performed adequately, but have to be documented in detail. Clinical work should typically be performed according to GCP an international ethical and scientific quality standard. Its main objective is to ensure that the data and reported results are credible and accurate, and that the rights of trial subjects are adequately protected.

The identification of hazards includes both a search for those hazards reduced or eliminated by inherently safer design, and a search for hazards controlled by instmmentation and administrative procedures. 

By identifying the potential sources of failures, it is possible to develop controls to address those hazards. These controls might be passive physical items (e.g., dikes, walls, vents), active physical systems (e.g., fire suppression, pressure limiters, temperature controls), or administrative procedures.

Maintenance operations, particularly those which are non-routine, require a sound system of work with strict administrative procedures, e.g. permit-to-work, to avoid risks arising from modifications to established safe practices. A permit-to-work should be used wherever the method by which a job is done is likely to be critical to the safety of the workers involved, nearby workers, or the public it is required whenever the safeguards provided in normal operations are no longer available. Procedures for appealing against decisions resulting from GMP and distribution-channel inspections exist in each of the countries. Some countries employ administrative procedures to handle appeals, some employ judicial control, while others combine both approaches.

In the same time pharmaceutical companies involved in production of antidotes must be encouraged to register their products in their own countries. In this respect, it is very helpful that administrative procedures of registration and disposal of an antidote, for example, will comply with international rules regarding the orphan drugs.

In order to maximize the benefit of any identified improvement, administrative procedures should be created and implemented which define distribution or lines of communication for information related to chemical reactivity hazard management improvements. It is possible that additional pressures may be needed to arrive at a satisfactory system, and some form of legislative backup may be desirable. Any law enacted, however, should be much simpler than either the German law or the Moss Bill. Such legislation should relate only to providing legal means to resolve otherwise unresolvable situations. It should not spell out in exhaustive detail the rights of the parties and the administrative procedures needed to implement these rights. 

Once you are classified, the tax result is more or less fixed. Therefore, it is important to be able to structure your situation in advance. The IRS has three administrative procedures whereby you can get a prior indication of the IRS thinking and then structure your situation to ensure the desired result. There have been various suggestions to address this situation, each with its own pros and cons. One proposal has been to establish an administrative procedure through which generic applicants could obtain substantive FDA review of listability. The FDA, however, has taken the position that it lacks the expertise and resources necessary to perform such a review, and its solely ministerial review of Orange Book listings has been upheld by the courts. At a minimum, it appears useful for the FDA to clarify its listing requirements see Appendix H).
