Patent Numbering

Apart from applications to national authorities, patent applications may also be made through the European Patent Office (EPO) and the International Bureau of the World Intellectual Property Organisation (WIPO) under the Patent Cooperation Treaty (PCT). 

The EPO was set up by the European Patent Convention of 1973, and its first patents were granted in 1980. At the end of 2008, contracting states to the EPO comprised the twenty-seven member states of the European Union plus Croatia, Iceland, Liechtenstein, Monaco, Norway, Switzerland, Turkey, and Macedonia. The EPO grants patents in whichever of these countries are designated on the specification, and the patent documents are published in English, French, or German. 

Chemical patents often contain Markush structures, named after Eugene Markush, who was the first inventor to win a claim allowing such structures in 1925. These generic structures allow large numbers of compounds to be claimed even though few of these will actually have been synthesised.

The reinaining five search topics (Research Topic, Author Name, Document Identifier, Company Namc/Organii ation, and Browse Table of Contents arc conducted in a similar fashion, with the input being the only difference between the criteria. Thus, in Research Topic" the entry can be any, or even several, keywords or phrases. In "Author Name", literature written by a specific author will be Found, including alternative spelling, Document Identifier" can also be entered directly in the query. Document identifiers arc CA abstract numbers, patent numbers, patent application numbers, or priority application numbers. The last two search topics (Company Name/Organi2ation, and Browse Table ofContents) allow one to search for literature from specific companies or to view the list of journals which are available in the database.

The Notice of Errors. The first mechanism for correction of errors is called a "Notice of Errors." This document may be filed by the patentee after issuance of the patent with the U.S. PTO and references the patent number, issue date, and the errors contained in the patent. The purpose of a Notice of Errors is to clarify the examination history of the patent and such notice dispositively corrects any misspellings, or typographical errors or omissions. One example of a problem which may be clarified by a Notice of Errors is an omitted chemical bond in a compound used in an exemplary embodiment of the invention. In short, the error is obvious and easily corrected.

The bibliography is sorted alphabetically by the first author. It is in this way an author index of the first author. Patents without authors are placed according to the patent numbers in the text. 

U.S. Patent and Trademark Office Web Patent Databases. The Patent and Trademark Office (PTO) [72] offers free World Wide Web access, http // www.uspto.gov/main/patents.htm, to a bibliographic patent database that uses the most current patent classification system, this may not match the classification data that appears on the printed patent, and to a full-text patent database that uses the classification data that appear on the printed patent, this may not match the current classification data. The databases start with January 1, 1976, patents. The full text of a patent includes all bibliographical data (e.g., inventor s name, the patent s title, the assignee s name, etc.) and the abstract, full description of the invention, and the claims. All the words in the text of the patent are searchable. If the patent number is known, the patent, regardless of year, can be ordered from the PTO. Automated searching of 1971 to date patents is available at some of the Patent and Trademark Depository Libraries. Prior to 1971 searching can be done at the PTO facilities or at the Patent and Trademark Depository Libraries. Commercial patent search services are also available. 

Drugs Under Patent. This book [77] is a cross-referenced listing of over 2500 drugs covered in the United States under patent law and marketing exclusivity provisions of the Waxman-Hatch Act. Eight indexes provide market and patent status information by company, trade name, generic name, expiration date, dosage form, exclusivity code, patent number, and NDA number. Updated annually, this book is available commercially.
