Shipment Certifications

The importer itself, or its authorized agent, must fulfill the TSCA certification requirement by filing either a positive certification if the chemical shipment is subject to TSCA and is in compliance with applicable TSCA requirements or a negative certification if the chemical shipment is not subject to TSCA. The Customs Regulations specify the exact language that must be used to make the applicable certification  

Positive Certification. I certify that aU chemical substances in this shipment comply with all applicable rules or orders imder TSCA and that I am not offering a chemical substance for entry in violation of TSCA or any applicable rule or order thereunder. 

Negative Certification. I certify that all chemical substances in this shipment 

The appropriate certification must be filed with the director of the port of entry before release of the shipment and must appear as a typed or stamped legend, except when subject to a blanket certification as discussed below, on (i) an appropriate entry document or commercial invoice or on an attachment to that entry document or invoice or (ii) in the event of a release for an immediate delivery, on the commercial invoice or an attachment to that 

Import Certifications are kept by the Customs Service. Copies of certifications are only forwarded to EPA when Customs suspects a violation. Living with TSCA Q8cA, question 48.

After coating the ceramic is ready for market. In some cases, customers require certification testing done before shipment. Certification testing is one way of assuring quality.

If testing involves a new product that is not yet in commercial trade, the manufacturer should ship products from the same batch of the same formulation to each test location. The most recent product quality analysis and an appropriate Material Safety Data Sheet (MSDS) must accompany the product shipment. The shipping documents and the certificate of analysis for each shipment must be archived in the raw data for the report. If the residue testing is being done to register a new use for a commercial product, the Study Director must make sure that the product available in each location is the same formulation and that each different batch encountered has its own certificate of analysis to be archived along with a copy of the label and product quality analysis of the material used for the test. Material shipped in noncommercial containers must... 

Treatment facilities have to send similar notifications along with the shipment of treated wastes to disposal facilities. A certification normally accompanies this notification stating that the waste meets its treatment standards and may be land disposed. Disposal facilities are the final link in the waste management chain. As a result, they have to test the waste residue that they receive to ensure that it meets the treatment standards. 

Of the remaining 29 FCOJ samples, 86 percent indicated pulpwash adulteration in amounts up to 60 percent. Twenty-five percent (6 of 25) of the SSOJ samples indicated pulpwash adulteration in amounts to 40 percent. State of Florida Citrus Fruit Laws (3J govern the inspection, grading, certification, sale and shipment within or without the State of all citrus fruit and the products thereof whether canned or concentrated. The laws also govern the licensing or certification of citrus fruit inspectors by the United States Department of Agriculture. There are no required inspections, grading or certification of a product repacked by other distributors out of the state of Florida. 

German Health Authorities may deny import certificate to plasma collectors who make a single error in interdicting shipment of a viral marker reactive unit or properly notifying fractionator... 

In addition, a consignment must be accompanied by an EU Certificate for the Import of Products from Organic Production , sometimes called a transaction certificate. The original must accompany the shipment to the first consignee and be kept by the importer for two years. The inspection/certification body who verified the operation of the exporter issues the certificate. 

REPKesentafciyg tat Sawles and Analyses- Suppliers of catalyst and fixed bed adsorbent are being requested to supply representative lot samples and analytical certificates for each nev purchase order at the time the catalyst is ready for shipment. The analytical results are being compared with updated purchase specifications. 

Does the contractor provide a protocol of analysis or a certificate of compliance for each lot of product at the time of shipment as well as copies of completed batch records ... 

Is the material in the shipment to be imported an article , or tobacco or tobacco product If yes, an import certification is not required (positive or negative). If no, continue to the next question. 

Is the material in the shipment to be imported a pesticide a source or special nuclear material or by-product a firearm or ammunition or a food, food additive, drug, cosmetic, or device If yes, the material is not subject to TSCA, but a negative TSCA import certification is required unless the shipment is clearly identified as being a pesticide or other chemical not subject to TSCA (e.g., the shipment is accompanied by FDA Form FD701 or EPA (FIFRA) Form 3540-1). If no, continue to the next question. 

Does the shipment contain any chemical substances or mixtures regulated under TSCA Section 5 (including new chemical substances), TSCA Section 6, or TSCA Section 7 If yes, continue to the next question. If no, a positive TSCA import certification can be made. 

Are the chemical substances and/or mixture in the shipment compliant with TSCA Sections 5, 6 If yes, a positive TSCA import certification can be made. If no, import certification cannot be provided and the shipment cannot be imported until the chemical substance and/or mixtures is compliant with all applicable requirements under TSCA Sections 5, 6, and 7. 

Under EPA and Customs regulations, the importer of a chemical substance or mixture must certify at the port of entry that each shipment is either subject to and in compliance with TSCA (a positive certification) or the shipment is not subject to TSCA... 

At PCAPP. the Colorado Department of Public Health and Environment (CDPHE) said that a modification to eliminate the use of the biotreatment unit and to add a loading facility for offsite hydrolysate shipments would probably be a Class 2 modification (one comment period of 6 months) or a Class 3 modification (two comment periods of longer duration)." Such a modification would also have to be approved by Pueblo County, and a new certificate of designation (COD) would have to be issued. No operations could be initiated until the Class 2 modification is approved and the COD is issued. 

The CDPHE has said there are various options for offsite shipment of hydrolysate. These options would require destruction of the agent by hydrolysis, followed by shipment to a publicly owned treatment works or a Safe Drinking Water Act permitted underground injection control unit. They are in addition to using an appropriate TSDF. The hydrolysate would have to be manifested as a hazardous waste and accompanied by an LDR notice of constituents and a certification of agent treatment. 

On June 11, 1999, the Ontario Ministry of the Environment (MOE) gave RBRC a provisional Certificate of Approval (COA) that exempts RBRC fi om having to use a permitted hazardous waste facility to accumulate Ni-Cds prior to shipment to recycling facilities. This COA was primarily intended to give RBRC a broader and more affordable choice of consolidators.
