Interim order

Interim order An official statement issued by OSHA allowing an employer to continue operations under existing conditions while an application for a variance is being considered. 

Variances are not retroactive. During the period of operation prior to receipt of a variance, if issued, OSHA may provide an interim order, allowing continued activity based on current methods. Details of such an interim order are subject to site pubhcation and employee-employer review. 

Safety and health professionals should be aware that there are several different types of variance actions to consider, including permanent variances, temporary variances, experimental variances, as well as variances for National Defense and recordkeeping as well as interim orders that often accompany the variance actions. Safety and health professionals should carefully analyze their unique situation and draft the written request specifically identifying the unique situation, any/all applicable standards, type of variance requested, and posting of notice and related information. It is important that safety and health professionals carefully analyze and research the situation with attention to applicable standards, interpretations, similar variance actions, and related research before applying for a variance.

The Assistant Secretary may issue a time-limited interim order pending the decision on the temporary variance, if such an order was requested by the applicant. 

For the above reasons, chronic exposure studies are frequently designed in such a way that it is possible to combine observations for tumorigenesis and noimeoplastic tissue injury. Chronic studies are usually extensively monitored. It is common practice to sacrifice animals at intervals during the study in order to detect the onset of any tissue injury. For two-year exposure studies, it is most meaningful to have interim sacrifices at 12 and 18 months. 

Interim measures may be separate from the comprehensive Corrective Action plan but should be consistent with, and integrated with, any longer-term Corrective Action (e.g., corrective measure through an order, an op erating permit, a post-closure permit or interim status closure requirements). To the extent possible, interim measures should not seriously complicate the ultimate physical management of hazardous wastes or constituents, nor should they present or exacerbate a health or environmental threat. Interim measures may add additional costs or work to the comprehensive Corrective Action. Such added costs or work do not preclude implementation of an interim measure. 

With the release of SAS 9, it is getting to the point where having a comprehensive set of hardcopy SAS manuals is difficult to afford in both monetary cost and physical storage space. The cost and size of SAS manuals have grown substantially. Also, each interim release of SAS now comes with a new set of documentation, so hardcopy versions of the manuals can rapidly get out of date. The cleanup of a site with hazardous waste contamination may be handled under either CERCLA, as described above, or RCRA. RCRA authorizes U.S. EPA to require corrective action (under an enforcement order or as part of a permit) whenever there is, or has been, a release of hazardous waste or constituents at TSDFs. The RCRA statute also provides similar corrective action authority in response to releases at interim status facilities. Further, RCRA allows U.S. EPA to require corrective action beyond the facility boundary. U.S. EPA interprets the term corrective action to cover the full range of possible actions, from studies and interim measures to full cleanups. Anyone who violates a corrective action order can be fined up to 27,500/d of noncompliance and runs the risk of having their permit or interim status suspended or revoked. 

Numerous radon and radon decay measurements in houses are now being made by a large number of private and governmental organizations. In order to assure valid and consistent measurements, it is important that proven methods be used following standardized procedures. To address this need, EPA issued "Interim Indoor Radon and Radon Decay Product Measurement Protocols" and established a Radon/Radon Progeny Measurement Proficiency program. 

A description is given of the initiatives carried out within the European Community for the harmonization of fire testing. The technical and economic reasons are explained for such initiatives, which are taken in order to remove barriers to trade from the European internal market. Of the various fire aspects, only fire reaction testing is taken into consideration here, because it appears as a major technical obstacle to the free circulation of construction materials. All possible approaches are considered for the attainment of such a harmonization and one, the so called interim solution, is fully described. The need to standardize olfactometric measurements is growing in the Netherlands. In 1984 interim limit values on odour concentrations were published in the Indicative Multiyear Programme to combat Air Pollution 1985-1989. This is a revised version of the 1983 proposal (3, 5). Any laboratory that conducts noncUnical laboratory studies must provide dedicated space for the storage of raw data, documentation, protocols, specimens, and interim and final reports from completed studies. The laboratory must have an orderly system for storing such material, and that system must provide an expedient method for retrieving of archived materials (e.g., on the request of an FDA inspector). 

For practical reasons, however, the number of interims should be small in number. Undertaking interims adds cost to the trial and they also need to be very carefully managed. After assessing the technical literature, a summary document (Figure 5) of the biological effects data is prepared for review by CACPH Advisory Panel and TMAC. This review results in a recommendation to draft a Toxic Material Advisory report which contains an interim exposure limit in additional pertinent health and safety requirements. The draft Toxic Material Advisory report is then reviewed by independent consultants. These consultants attend a 1-2 day meeting to evaluate the document and the appropriateness of the interim exposure limit. Until recently, the potential of chemical flue gas conditioning was not fully appreciated by regulatory agencies. Utilities would try to use chemical conditioning in order to reach compliance levels of emissions. If they failed to do so, they were required to invest in retrofit ESP units or baghouses. During the interim period, most units were allowed to operate under a compliance schedule. This could cover a period of two to three years or until the new equipment was in place and operating. Emissions were, in effect, allowed to continue in an uncontrolled manner. 

The outcome of the development stages are the final production drawings which are released to the manufacturing plant for production. An interim step is the ordering of tooling as soon as the production drawings are available to tool engineering. Once the tools and equipment are available to production, a tool and material tryout is conducted and any problems that may exist are corrected.
