Incorporation by reference

S = specified minimum yield strength, psi, stipulated in the specifications under which the pipe was purchased from the manufacturer or determined in accordance with (c) below. The specified minimum yield strengths of some of the more commonly used pipeline steels whose specifications are incorporated by reference herein are tabulated for convenience in Table IX-1B. 

The protocol should be incorporated by reference into the contract. 

RAFs are adopted in Section 13 of the California Exhaust Emission Standards and Test Procedures for 1988 and Subsequent Model Passenger Cars, Light-Duty Trucks, and Medium-Duty Vehicles, and the process for establishing RAFs is in Appendix VIII of that document. The document is incorporated by reference in Title 13, California Code of Regulations, Section 1960.l(k) see also California Air Resources Board (1992a, 1993). The last amended date is March 19, 1998. 

Waste solids are defined as heterogeneous materials that range from sticky, viscous, or tarry material to dry solid particulates. Special techniques for the treatment of oily, gummy, and adhesive materials (e.g., addition of anhydrous sodium sulfate or silica gel) are specified in the protocol. The gravity phase-separation procedure (24 h at 4 °C) developed by the Environmental Waters and Waste Water Work Group is incorporated by reference to address the removal of liquids from waste solids samples. The waste solids protocol can also be applied to solids partitioned from aqueous or nonaqueous liquids or from gaseous media. 

Compositions of silver in water can be made according to procedures set forth in U.S. Pat. No. 6,214,299, incorporated by reference herewith. 

The Oregon Department of Environmental Quality (ODEQ) has incorporated by reference the federal RCRA regulations for identification and listing of hazardous wastes (Oregon Administrative Rules 340-101-001). In addition to the federally listed acute hazardous wastes, ODEQ regulations include the following as state-specific listed hazardous wastes ...

Applicants may incorporate by reference any information previously submitted in DMFs or other applications. An incorporation by reference should be made in that segment of the application in which the information referenced would ordinarily appear. 

References should be identified by name, reference number, volume, and page number in the FDA s records where the information can be found. If an applicant incorporates by reference information to the FDA by another person, the applicant should obtain and include in the application a written statement from that person authorizing the reference. 

Tolerances The analytical weights meet the tolerances of the American National Standard ANSI/ASTM E617, Laboratory Weights and Precision Mass Standards. This standard is incorporated by reference and should be consulted for full descriptions and information on the tolerances and construction of weights.3 Where quantities of 25 mg or less are to be accurately weighed, any applicable corrections for weights should be used. 

The adoption and enforcement of codes and standards in the U.S. takes place under the jurisdiction of some 44,000 entities that include city, county, and state governments, as well as special districts such as port and tunnel authorities. Regulations make use of existing standards, either by incorporating appropriate sections of the standards (incorporation by transcription), or by referring to those sections (incorporation by reference). The extremely decentralized enforcement of codes and standards means that the permitting process for hydrogen fuel facilities can be very cumbersome. 

For a veterinary drug application approved on or after July 1, 1975, after an approval has been published in the Federal Register, a Freedom of Information (FOI) summary must be prepared that summarizes the safety and effectiveness data and the information submitted with or incorporated by reference in the application file [21 CFR 514.11(e) (2) (b) (ii)]. Information pertaining to veterinary FOI summaries can be found on the CVM website (http //www.fda.gov/ cvm/efoi/efoi.html). 

Industry consensus standards are sometimes incorporated into the regulations by reference and become a regulatory requirement. Examples of some these standards incorporated by reference in the regulations for gas pipelines are listed in Table 1. Claim can be dependent or independent a dependent claim incorporates by reference all the limitations of the claims to which it refers and is always narrower must depend on a preceding claim and not on a following claim (numbering of claims is readjusted during prosecution). 

Incorporates by reference all the limitations of the particular claim in relationship to which it is being considered (individually and not collectively). 

If an amendment or supplement refers to more than one PMA, three copies of the submission must be submitted for each PMA. If more than one PMA is affected by the submission, the applicant may wish to submit three complete copies to one of the PMAs and cover letters to the other PMAs that incorporate by reference that complete copy and identify all affected PMAs. 

In addition to DOE Orders, it includes Occupational Safety and Health Administration (OSHA), National Fire Protection Association (NFPA), American National Standards Institute (ANSI), and Compressed Gas Association (CGA) requirements that are cited in either DOE O 440.1A or in OSHA standard 29CFR1910.6 ("Incorporation by Reference"). It also includes technical standards that are made mandatory by their specific reference within a regulation, rule or DOE Order.
