Interruption of business

No wonder the building process is often viewed by participants as a painful interruption of business as usual rather than as a celebration of growth and financial success for the corporate team. 

Before an accident occurs, you should contact emergency services— medical, paramedical, fire department, police, utilities, bomb disposal, and poison control—to determine their procedures for response. Operation and locations of emergency shutdown switches of equipment must be identified unless it must be operating to prevent further damage or loss. Be prepared to isolate sources of secondary accidents and injuries. As well, provide for interruption of business for sufficient periods to permit thorough investigation. 

That said, railroads are motivated to settle possible claims quickly to avoid costly law suits and adverse local publicity. Conversations I have had with railroad lawyers suggest that railroads will offer to pay for costs incurred by businesses such as clean up and damage to inventory. Railroads would probably not pay for profits foregone due to the interruption of business. Individuals will be offered compensation, based on their actual hourly wages, if they are unable to go to work due to evacuation of their homes or workplace. People displaced from their homes are usually offered compensation for actual out-of-pocket expenses, but not for any emotional costs they may incur.

Cost of business interruption. The cost of business interruption is significantly influenced by various commercial factors. For example, if you are not producing at fiill capacity it may be possible to make up lost production at other facilities or when the plant comes back into operation. The business interruption costs will only be the additional costs of production, transportation and any lost sales. As these conditions can vary from month to month it may be more appropriate to adopt a standard method of calculating business interruption costs for PSM and ESH purposes. One commonly adopted approach is to estimate the tonnage of production lost and calculate the cost as being the difference between the sale price and all manufacturing, storage and transportation costs. 

The number of meetings varied significantly between one to five over a 6-month period. Time pressure was a significant factor here, along with a reluctance by some mentees to interrupt the busy schedule of their mentor.

Business-interruption insurance. The loss of income due to a business interruption caused by a fire or other emergency may far exceed any loss in property. Consequently, insurance against a business interruption of this type should be given careful consideration. 

It is important to prepare for the consultation, as quite often you will be interrupting a busy surgery. There are two main issues the patient and the drug. Before speaking to the prescriber you need to obtain the complete picture and formulate plans. References need to be checked, such as the British National Formulary, summary of product characteristics, other drug information, etc. You also need full information with regard to the patient, name, address, age, most of which will be available from the prescription. The NHS number (or equivalent) for the patient should also be available. 

Most property damage accidents result in business interruption and financial loss. A contact need not necessarily cause injury or damage to cause some form of interruption of the business. The interruption may either be major or minor, depending on the severity of the contact. Invariably a contact causes some form of loss. If substantial time is lost restarting a machine or rectifying a continuous process that has been interrupted as a result of an accidental contact, it is a loss.

Habermas Identifies these stmctural risks as including interruptions of the accumulation process conditioned by the business cycle, the external costs of a private production that cannot adequately deal with the problem situations it itself creates, and a pattern of privilege whose core is a structurally conditioned unequal distribution of wealth and income (1976 194).

A contact need not necessarily cause injury or damage, but may well end up in some form of interruption of the business at hand. 

The final part of the analysis (bottom of Figure 24.21 is the calculation of probable loss of property and loss of business if a fire or explosion were to occur. The area likely to be damaged is estimated from the F EI. The value of the equipment in this area ( 5 million in the exanple) is used to estimate the likely property loss, which is a function of loss control credits. The business interruption loss is estimated based on (1) probable days of outage and (2) annual fixed costs plus before-tax profit. 

The term accident refers to personal injury and loss. Given that a minimum level of profitability is essential for a business, the prevention of losses is a key factor. All accidents, whether they result in personal injury, property and plant damage and / or interruption of the business activity, represent losses to an organisation. Experience indicates that managers frequently complain about the cost of safety. What they never consider are the losses to the organisation as a result of accidents ... 

Offshore installations, which are operated in extreme marine environment, are essentially threatened by the various hazards to cause harms injury or death of humans, damage to asset, degradation of the physical and biological environment, and interruption of oil and gas production and disruption of business (Spouge 1999).

Not all types of harm are recoverable. For many years, plaintiffs were unable to recover purely economic losses such as increased business expenses or lost revenue. However, there is a trend to allow such claims with the major case involving a railroad. In the case of People Express Airlines, Inc, v. Consolidated Rail Corp. (100 N.J, 246, 495 A. 2d 107 (1985)), the court ruled that the airline was able to recover damages caused by an interruption of its business caused by the release of hazardous chemicals from a Conrail tank car. The court allowed the claim because it was felt that Conrail should have foreseen the harm that a chemical spill would have on businesses adjacent to the railroad. Despite the judgement in the above case, railroad lawyers have expressed the opinion that the majority of legal sentiment is still unfavorable to the recovery of economic losses.
