At Site I, the prime contractor s SSAHP required daily site inspections, the documentation of safety and health deficiencies, and the abatement of deficiencies. Records of site deficiencies, however, were kept intermittently, and hazard abatement was not documented. The subcontractor s SSAHP did not address site inspections and hazard abatement, but its TSCA permit application included requirements for site inspections. Inspection documentation, however, was not available on site, and the site manager was unaware of these written requirements. The site manager did, however, indicate that he conducted site inspections using a mental checklist and that he conducted inspections of remediation equipment before each use.

The vendor certification procedure may include a list of selected vendors, historical review of test results of previous suppliers, and formal inspection on site and decision making.

PRIMARY REVIEW Inspections (Manufacnring Sites, Clinical Sites)... 

Within this approach lays the possibility of various levels of assistance by the inspected State Party offering equipment, such as the use of inspected site laboratory facilities, fumed hoods, and the like. Such offers are laid down in facility agreements concluded between the inspected site and the OPCW, following an initial inspection. However, fundamental to this approach is that sample preparation and analysis are conducted by OPCW inspectors according to OPCW-approved procedures with equipment that meets OPCW QA/QC criteria. All activities may be witnessed by inspected State Party representatives. 

Once POE procedures are completed, the inspection team and the equipment are transported to the inspection site. 

On their arrival at the OPCW Laboratory, all seal numbers and the end pattern of the fiber-optic seals will be compared to the seal numbers and photographs received from the inspection site, if so requested in the presence of an ISP representative. Unpacking will be performed in a dedicated area for handling of authentic samples in the OPCW Laboratory. The vials containing the authentic sample splits will be weighted but left closed and sealed as received from the inspection site. For dispatch to each designated laboratory, one authentic sample split is packed together with a pre-analyzed control sample and the respective matrix blank in a transport container in the same manner as described above. Sampling and analysis (S A) during inspections is one of the verification tools provided for by the Chemical Weapons Convention (CWC) (1). Chemical analysis of a sample is the only direct and scientific (and not only circumstantial) tool to confirm the presence of a chemical substance. The presence of a declared chemical in a declared place at a declared time and in declared quantities confirms the declaration provided by a State Party to the OPCW (Organization for the Prohibition of Chemical Weapons). The actual or past presence of a chemical, which should not be at the inspected site according to the declarations, or, which has... 

The presence of the only one and removable hard disk was requested by decision of Conference of the State Parties on its first session (3). In Attachment 6 of the decision 71 concerning specific operational requirements for GC/MS system, it says that all data in nonvolatile memory must be retainable at the inspected site under joint custody of the Technical Secretariat (TS) and the inspected State Party. The hard disk with all raw data may be considered as containing highly protected information and requested to be left on site of inspection. 

The panned heavy mineral concentrates have not generally been analysed unless follow-up work has been carried out. However, all are inspected at site and observed minerals and contaminants are recorded. The samples are an excellent resource for identifying drainage catchment mineralisation and lithologies as well as anthropogenic contamination (Fig. 4.8). Indeed, all the G-BASE excess samples are stored at the National Geological Data Centre, Keyworth, UK, and are available for further study. The value of excess sample powders in research should not be underestimated.

In assessing whether and, if so, to what extent these requirements are fulfilled, the following elements seem relevant the kind of information that would be required to be provided when requesting an inspection how a decision on such a request would be made whether there is a right of refusal on the part of the challenged state whether there is any quota or limit to the request or receiving of inspections whether there are any restrictions in terms of specifying inspection sites the timeline between the decision to conduct an inspection and its actual implementation and the intrusiveness of inspection activities. 

According to the challenge inspection procedure in the CWC, the requesting State Party is first required to submit an inspection request to the Executive Council of the OPCW (where the decision on the challenge inspection would be made) as well as to the Director-General of the Technical Secretariat. The request must contain, at least, the following information (a) the State Party to be inspected, (b) the point of entry into the inspected State Party, (c) the size and type of the inspection site,... 

The inspection team, after arriving at the point of entry of the inspected State Party, would not move immediately to the inspection site. This is because, although the inspection of a particular site would already have been requested by the requesting State Party, the exact site for inspection would still need to be determined through negotiations between the inspection team and the inspected State Party. 

The inspection site, indicated with perimeter , would first be proposed by the requesting State Party. If this requested perimeter is acceptable to the inspected State Party, it will become the final perimeter , and the inspection team will be transported to that final perimeter if not, the inspected State Party must propose an alternative perimeter . If the alternative perimeter is acceptable to the inspection team, it will become the final perimeter if not, the perimeter negotiations will continue at the alternative perimeter. If no agreement is reached on the perimeter of the inspection site, the alternative perimeter will be designated as the final perimeter. 

In any event, the inspection team is allowed to have access, within the requested perimeter , not later than 108 hours after the arrival of the inspection team at the point of entry (Verification Annex, Part X, para. 39). It should be noted, however, that the inspected State Party must have been provided with information regarding the location of the requested inspection site at the latest 12 hours before the inspection team s arrival at the point of entry (Verification Annex, Part X, para. 6). Thus, the inspected State Party would have at maximum roughly 120 hours (five days) to prepare for the inspection. 

On the other hand, the way in which the inspection is to be conducted is rather constrained. In terms of the timeline, the inspection team might have to wait up to five days before being permitted to enter the requested inspection site. Access itself could also be hmited by the inspected State Party using the managed access technique.
