Safety mandates

The standard of safety mandated by the U.S. Congress is a reasonable certainty that no harm will result from the proposed use of an additive , which has been interpreted by the FDA to mean that there is a reasonable certainty in the minds of competent scientists that the substance is not harmful under the intended conditions of use (Code of Federal Regulations 2013). The burden of ensuring that a prospective FCM meets this safety standard is the responsibility of manufacturers, who must prove to the FDA that aU materials coming in contact with food are safe under... [Pg.104]

With the change in administration incoming Secretary of Transportation Brock Adams abandoned the Coleman Rule on the bases that public acceptance is not part of the traffic safety mandate, passive restraints clearly will be effective in improving traffic safety and the cost of the restramts will be more than offset through savings on insurance premium payments. In June 1977 under the Adams Rule, passive restraints were mandated for standard and luxury cars by the 1982 model year, for intermediate and compact size cars by the 1983 model year, and for subcompact and mini-size cars by the 1984 model year. The Adams Rule survived congressional and judidal review. ... [Pg.82]

Any review of NHTSA decisions about vehicle safety standards must recognize the assumption on which the safety mandate is based and the judgment required to interpret the directions given. The fundamental assumption is that there are too many traffic injuries and that regulatory action must be taken to reduce them to an acceptable level. The stated purpose of the Vehicle Safety Act is to reduce traffic accidents and death and injury from traffic accidents the assumption is that losses without the law are unacceptable. Motor vehicle safety is defined in the statute as vehicle performance which protects persons against unreasonable risks the assumption is that vehicle safety standards will reduce the risks to a reasonable level. Standards are supposed to be practicable in terms of several factors including the ultimate cost (if any) to the consumer. [Pg.97]

Coal-Mine Dusting. A steady market for pulverized limestone is ia dusting coal mines with a noncombustible mineral dust as a federally mandated mine safety requirement. Of aU mineral dusts, limestone is by far the most commonly used (60—75% 0.074 mm (200 mesh)). Consumption ia 1991 was... [Pg.179]

Exceptions to the preceding requirements would apply where explosionproof equipment is needed building ceiling heights are such that the standard 3.7-m (12-ft) lift is all that wih ever be needed and loads will never exceed 1 to 1.5 tons. Safety requirements for lift trucks are mandated by OSHA, by NIOSH (National Institute of Occupational Safety and Health), by State Depts. of Labor, and often by individual company standards. Among these requirements are backup-movement signals, seat belts, overhead framework for pro-... [Pg.1975]

The buyers of motor vehicles have been substantially positive concerning the need to have cleaner running vehicles. Although the required emission control devices and other mandated safety equipment have increased the cost of new motor vehicles, sales have not been significantly effected. The current environmental awareness and concern are evidence of the general population s new found knowledge and acceptance of both mobile and stationary source emission controls. [Pg.237]

The OSHA standard (29 CFR 1910.120) mandates that site safety and health programs require task- and operation-speeifie hazard analyses be eondueted at the site. These analyses are intended to ensure a eom-prehensive and systematie approaeh to hazard antieipation, reeognition, and evaluation at hazardous waste sites. Sinee work operations and site eonditions ehange at different stages of the remediation proeess, the potential hazards assoeiated with eaeh operation must be reevaluated periodieally to ensure that employees reeeive appropriate proteetion. [Pg.188]

This analysis forms the basis of a widely used industry consensus standard, American Petroleum Institute, Recommended Practice 14C, Analysis, Design, Installation, and Testing of Basic Surface Systems for Ofi- i orc Production Platforms (RP14C), which contains a procedure tor dcicnniniiig required process safety devices and shutdowns. The procedures ilescribed here can be used to develop checklists for devices not covered by RP14C or to modify the consensus checklists presented in RP14C in areas of the world where RPI4C is not mandated. [Pg.387]

The Occupational Safety and Health Act (OSH Act) was enacted by Congress in 1970 and established tlie Occupational Safety and Health Administration (OSHA), which addressed safety in tlie workplace. At tlie same time tlie USEPA was created. Both USEPA and OSHA are mandated to reduce tlie exposure of Itazardous substances over Umd, sea, and air. Tlie OSH Act is limited to conditions that exist in the workplace, where its jurisdiction covers both safety and health. Frequently, both agencies regulate tlie same substances but in a different manner as they are overlapping environmental organizations. [Pg.67]
