The person requesting that construction work commence, the client, must first of all appoint a duty holder , someone who has a duty of care for health, safety and welfare matters on-site. This person will be called a planning supervisor . It is proposed that the requirement to appoint safety supervisors will be triggered by the contractor employing five or more persons. This will bring the Construction (General Provisions) Regulations into line with HSW whereby the employment of five or more persons requires the contractor to have a written safety policy. The purpose of the appointment of the safety coordinator in project is to elaborate the Health and Safety Plan (HSP) at the project phase, to ensure the safety and health of all staff involved in the construction site, support the developer for the negotiation of the contract issues and the implementation of preparatory work with regard to safety and health matter. The safety coordinator in project has the duty to organize the safety File and to complete the most unfavourable situations, in case there is no safety coordination in construction (SCC). In the Construction (Design and Management) Regulations 1994 (CDM), the client s main duties are contained in Regulations 6,10, 11 and 12. A client is defined as any person for whom a project is carried out, whether carried out by another person or in-house . Where projects are carried out for domestic (non-commercial) clients, most of the CDM requirements apply neither to the contractor nor to the client, unless the client is also a client of a developer, when by Regulation 5 the domestic house developer is the de facto client until the project is completed. 

The Planning Supervisor s duties do not extend to the making of requirements as to the construction methods used, or to carry out any health and safety management function in respect of contractors or the work. These duties may, of course, be carried out by the person acting both as Planning Supervisor and in another capacity on the project. 

It is a central feature of CDM that all duty holders (except the client) must be competent, and the Regulations specify that certain steps must be taken to ensure that only competent duty holders are selected. No contractor can be employed to carry out or manage construction work unless the person employing them is satisfied as to their competence. That duty will only be discharged when reasonable steps have been taken, which include making reasonable enquiries or seeking advice where necessary.
