Liability compensation

The following distinction is made in some discussions of product liability. Strict liability compensation is provided by the pnxlucer/manufactuier. No-fault liability or scheme compensation is provided by a central fund.

The EPA Contract Laboratory Program (CLP) has responsibility for managing the analysis programs required under the U.S. Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). The approved analytical methods are designed to analyze water, soil, and sediment from potentially hazardous waste sites to determine the presence or absence of certain environmentally harmful organic compounds. The methods described here all require the use of GC/MS. 

The analysis programs of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) are managed through the EPA s Contract Laboratory Program (CLP).

This chapter addresses the potential for hazardous air emissions from environmental remediation sites. These emissions can occur at hazardous spill locations, at undisturbed remediation sites, and during cleanup of remediation sites under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) or the Superfund Amendments and Reauthorization Act (SARA). Air emissions may pose a potential health risk at these sites. 

CERCLA Comprehensive Environmental Response Compensation and Liability Act. 

Any substance designated under the Clean Water Act and the Comprehensive Environmental Response Compensation and Liability Act (CERCLA) as posing a threat to waterways and the environment when released. 

Under this provision, facilities should notify the LEPC and consequently the SERC of any possible environmental release of specific chemicals. The specific chemicals referred to in SARA Title III are found on the Extremely Hazardous Substance List (40 CER 355) and the Reportable Quantity List (the Comprehensive Environmental Response, Compensation, and Liability Act [CERCLA] Section 103 [a]). 

The primary motivation of PSAs is to assess the risk of the plant to the public. The immediate purpose of the RSS was to support the Price-Anderson hearings on liability insurance (i.e., assess the financial exposure of a nuclear power reactor operator) a purpose which, even today, is beyond PSA technology. However, PSA is sufficiently precise to provide relative risk comparisons of reactor designs and sites. These uses of PSA were presented at the Indian Point hearings, and in defense of Shoreham. The PSAs for the high-population-zone plants (Limerick, Zion, and Indian Point) were prepared to show that specific features of these plants compensate for the higher population density relative to plants studied in the RSS. 

Provides information about all RCRA regulations and programs including the Resource Conseiwation and Recovery Act (RCRA) Comprehensive Environmental Response Compensation and Liability Act (CERCLA, or Superfund) and Emergency Planning and Community Right-to-Know Act (EPCRA)/Superfund Amendments Reauthorization Act (SARA) Title III. Agency (EPA), which was established in 1970, the same year the first Clean Air Act was passed into law. In 1972 the Clean Water Act became law, and in 1973 the Endangered Species Act became law. Other important federal environmental legislation includes the Resource Consei vation and Recoveiy Act, passed in 1976 the Response, Compensation, and Liability Act of 1980 the Nuclear Waste Policy Acts of 1982 and 1987 and the Low-Level Radioactive Waste Policy Acts of 1980 and 1985. From 1980 to 2000 these environmental regulations, and the enforcement efforts of the EPA, have had a much greater impact on decisions made in the energy industiy than all the policy initiatives implemented by the DOE. 

A breach of duty under either common law or statute that causes injury or damage may result in those responsible having a legal liability to pay compensation (termed damages) to the aggrieved party. 

As previously stated, a business can be held legally liable to pay compensation (damages) for injury or damage caused by its activities, and a successful action against it may result in large financial demands upon the business. Liability insurance ensures that, subject to satisfactory compliance with specified conditions and procedures by the insured, funds are available for a business if it is held... 

The toxicological profiles are developed in response to the Superfund Amendments and Reauthorization Act (SARA) of 1986 (Public law 99-499) which amended the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA or Superfund). This public law directed ATSDR to prepared toxicological profiles for hazardous substances most commonly found at facilities on the CERCLA National Priorities List and that pose the most significant potential threat to human health, as determined by ATSDR and the EPA. The availability of the revised priority list of 275 hazardous substances was announced in the Federal Register on November 17, 1997 (62 FR 61332). Section 104(i)(3) of CERCLA, as amended, directs the Administrator of ATSDR to prepare a toxicological profile for each substance on the list. 

These experts collectively have knowledge of methyl parathion s physical and chemical properties, toxicokinetics, key health end points, mechanisms of action, human and animal exposure, and quantification of risk to humans. All reviewers were selected in conformity with the conditions for peer review specified in Section 104(I)(13) of the Comprehensive Environmental Response, Compensation, and Liability Act, as amended.
