Works Made for Hire. In many instances one person has created a work at the behest of another. In such circumstances, the creator does not own the copyright. As an easy example, consider a company that manufactures an appHance and has one of its employees write an instmction manual for the apphance. Logically, the company, and not the employee, should own the copyright. [Pg.264]

Such situations are governed by the work-made-for-hire doctrine of the Copyright Law. Under the Copyright Law, copyright ownership vests initially in the author of the work. In cases of works made for hire, the law specifies that the employer or other person for whom the work is prepared is deemed to be the author (9). Thus the apphance company would be deemed to be the author, and hence the initial copyright owner, of the copyrighted instmction manual. [Pg.264]

The law specifically defines what is and is not a work made for hire. It allows for two, and only two, possibiUties. [Pg.264]

Second, a work may be a work made for hire if it is specially ordered or commissioned and meets both of the following requirements (/) it must be a contribution to a collective work, part of a motion picture or other audiovisual work, translation, a supplementary work, a compilation, an instmctional text, a test, answer material for a test, or an atias and (2) the parties must expressly agree in a written instmment signed by them that the work is to be considered a work made for hire. [Pg.264]

Because the circumstances under which an independendy commissioned work is considered a work made for hire are limited, the commissioning party is likely to seek a transfer of copyright in the form of an assignment or Hcense. [Pg.264]

Productivity of local craft labor also depends on the use and avail-abihty of modern mechanical tools and construction equipment. Normally, the low cost of labor in certain countries tends to cut out the purchase or hire of sophisticated laborsaving equipment and to encourage the employment of large pools of labor, particularly in developing countries such as India, Pakistan, southeast Asian countries, and many African countries.
