Most companies hire a drilling contractor to supply equipment and manpower rather than having their own rigs and crews. The reasons for this are threefold ... 

The cost of an analysis is determined by many factors, including the cost of necessary equipment and reagents, the cost of hiring analysts, and the number of samples that can be processed per hour. In general, methods relying on instruments cost more per sample than other methods. 

Manpower Labor Contracts. Some faciUties prefer a strict manpower contract that suppHes skilled or unskilled labor as requited to fill ia and supplement an existing workforce. Arrangements can be made at the outset for temporary workers to be hired by the faciUty, if the need for thein service continues and they fit well iato the ia-house organization. 

If a consultant is hired to do the study, it is equally important for the cHent to inform the consultant of its need ia detail. Contract carriers generally are not held to the same standard of HabiHty as common carriers because they are considered ordinary for-hire bailees and, therefore, are Hable only for their failure to exercise a reasonable degree of care for goods in their custody or possession, although such HabiHty may be varied by the contract. However, motor carriers providing service under contract are held to the same HabiHty standard appHcable to common carriers unless the statutory provisions imposing the standard are waived in the contract.

Works Made for Hire. In many instances one person has created a work at the behest of another. In such circumstances, the creator does not own the copyright. As an easy example, consider a company that manufactures an appHance and has one of its employees write an instmction manual for the apphance. Logically, the company, and not the employee, should own the copyright. 

Such situations are governed by the work-made-for-hire doctrine of the Copyright Law. Under the Copyright Law, copyright ownership vests initially in the author of the work. In cases of works made for hire, the law specifies that the employer or other person for whom the work is prepared is deemed to be the author (9). Thus the apphance company would be deemed to be the author, and hence the initial copyright owner, of the copyrighted instmction manual. 

The law specifically defines what is and is not a work made for hire. It allows for two, and only two, possibiUties. 

Second, a work may be a work made for hire if it is specially ordered or commissioned and meets both of the following requirements (/) it must be a contribution to a collective work, part of a motion picture or other audiovisual work, translation, a supplementary work, a compilation, an instmctional text, a test, answer material for a test, or an atias and (2) the parties must expressly agree in a written instmment signed by them that the work is to be considered a work made for hire. 

Because the circumstances under which an independendy commissioned work is considered a work made for hire are limited, the commissioning party is likely to seek a transfer of copyright in the form of an assignment or Hcense. 

Productivity of local craft labor also depends on the use and avail-abihty of modern mechanical tools and construction equipment. Normally, the low cost of labor in certain countries tends to cut out the purchase or hire of sophisticated laborsaving equipment and to encourage the employment of large pools of labor, particularly in developing countries such as India, Pakistan, southeast Asian countries, and many African countries. In turn, this usually leads to higher construc tion costs. The use of laborsaving eqiiipment is prevalent in Canada, western Europe, Japan, and, to an increasing extent, the Middle East.

Check whether for the various levels of personnel there is an induction training for all new-hires, a formal training and refresher training in the area of quality, safety, job skill improvement and so on.
