Contract hire

Contract hire. Although not strictly a source of outside finance, this is a method of avoiding capital outlay, especially favored for vehicles. Again, there are many varying systems to be found. [Pg.1038]

It is not uncommon for a group of new or recent graduates in computing to decide to set up their own company to provide software services. Initially at least, their intention is typically to offer contract hire services, that is, to offer their services as programmers charging a daily fee. Not infrequently, however, they also intend to develop packages to meet perceived gaps in the market. [Pg.52]

Even if the intention is only to cany out contract hire work, there will be a need to have some money with which to start the venture. Invoices are normally issued at the end of a month to cover the work that has been done during the month. A client is unlikely to pay an invoice within less than one month of receiving it. Even in a large plant where a number of employees skilled in each maintenance trade are needed full time, contract maintenance may be used as a supplement at times of turnarounds (a planned time when large continuous plants are shut down to do preventive maintenance, repairs, and inspections) or especially heavy demands. For instance, during the turnaround of a 140,000 bbl/day (22,000 m3/day) Tidewater Oil Company refinery, the number of maintenance personnel rose from a preshutdown level of 181 to 924 men.48 Fewer men could have been used, but the downtime of the refinery would have been increased. In this instance the plant contracted for all of its maintenance. [Pg.211]

The story of how this principle became the accepted legal doctrine in this country is a curious one. Professional employees traditionally had been employed under oral or, in some cases, written employment contracts that ran for an indefinite term. Under the English common law, when no particular term of employment was stated, the hiring was presumed to be for one years service. If the employment continued beyond one year, it was thereafter terminable only at the end of an additional year. Other than this power unilaterally to terminate at one-year intervals, both parties, under the English rule, would be bound as long as they both remain satisfied with the performance and the working conditions. In other words, except for the power to terminate automatically on the anniversary of the date on which the contract was made, both parties could terminate only for a good cause shown. [Pg.76]

In the United States the rule was quite different. Unless the life of the employment contract is specifically spelled out, such a hiring is deemed terminable at will by either party. Whether the contract provides for payment at stated intervals, such as every two weeks, once a month, etc., or even characterizes the employment as permanent, has no effect upon the legal result.
