Contract hire

Contract hire. Although not strictly a source of outside finance, this is a method of avoiding capital outlay, especially favored for vehicles. Again, there are many varying systems to be found. 

It is not uncommon for a group of new or recent graduates in computing to decide to set up their own company to provide software services. Initially at least, their intention is typically to offer contract hire services, that is, to offer their services as programmers charging a daily fee. Not infrequently, however, they also intend to develop packages to meet perceived gaps in the market. 

Even if the intention is only to cany out contract hire work, there will be a need to have some money with which to start the venture. Invoices are normally issued at the end of a month to cover the work that has been done during the month. A client is unlikely to pay an invoice within less than one month of receiving it. Two months is more likely with commercial clients and three months is not uncommon some large companies are notorious for not paying invoices for as much as six or even twelve months. The result is that the group needs enough cash in hand to be able to five for at least three months. Additional money will be needed for the expenses of starting the compatty. 

Contract hire agreements are very much simpler than fixed price contracts because the supplier s involvement and responsibility are so much less. Issues such as delay payments, acceptance tests and many others simply do not arise however, as mentioned earlier, ownership of intellectual property rights generated in the course of the work must... 

Manpower Labor Contracts. Some faciUties prefer a strict manpower contract that suppHes skilled or unskilled labor as requited to fill ia and supplement an existing workforce. Arrangements can be made at the outset for temporary workers to be hired by the faciUty, if the need for thein service continues and they fit well iato the ia-house organization. 

Contract carriers generally are not held to the same standard of HabiHty as common carriers because they are considered ordinary for-hire bailees and, therefore, are Hable only for their failure to exercise a reasonable degree of care for goods in their custody or possession, although such HabiHty may be varied by the contract. However, motor carriers providing service under contract are held to the same HabiHty standard appHcable to common carriers unless the statutory provisions imposing the standard are waived in the contract. 

Operation and Maintenance. Engineering and constmction firms can be contracted to take charge of treatment-plant operation and maintenance and manage other aspects necessary to meet performance goals, such as hiring and cost controls (7). Costs to the municipalities are reported to be competitive with the more traditional approach of management by municipal employees (8). 

Contractor/snbcontractor A party in either the prime or subcontractor role, or otherwise providing goods or services to the organization, who performs some of the obligations of a particular prime contract. For example, a contractor hired to put up temporary fencing around a work area to control access would be a subcontractor who must be prequalified. 

Human resources, whether in-house or retained by contract, cost money, and represent either a direct or an indirect investment. In lobbying for PSM resources, be realistic about the time you think the effort will require underestimating the level of effort can raise management s expectations beyond your ability to meet them. For instance, during the turnaround of a 140,000 bbl/day (22,000 m3/day) Tidewater Oil Company refinery, the number of maintenance personnel rose from a preshutdown level of 181 to 924 men.48 Fewer men could have been used, but the downtime of the refinery would have been increased. In this instance the plant contracted for all of its maintenance.

The story of how this principle became the accepted legal doctrine in this country is a curious one. Professional employees traditionally had been employed under oral or, in some cases, written employment contracts that ran for an indefinite term. If the employment continued beyond one year, it was thereafter terminable only at the end of an additional year. Other than this power unilaterally to terminate at one-year intervals, both parties, under the English rule, would be bound as long as they both remain satisfied with the performance and the working conditions. In other words, except for the power to terminate automatically on the anniversary of the date on which the contract was made, both parties could terminate only for a good cause shown. 

In the United States the rule was quite different. Unless the life of the employment contract is specifically spelled out, such a hiring is deemed terminable at will by either party. Whether the contract provides for payment at stated intervals, such as every two weeks, once a month, etc., or even characterizes the employment as permanent, has no effect upon the legal result. The contract is terminable at the will of either party.
