The technical and economic constraints and the legal environment affect the choice of the contractual framework for gas deliveries via pipeline. For example, depending on the number of suppliers and clients, and the regulations governing the construction and operation of a gas pipeline, the role of the pipeline can be that of a gas merchant, a hybrid pipeline or a gas transporter. A merchant pipeline typically buys all the gas at the inlet point, transports it and re-sells it at outlets to different clients it does not provide third party access, unless specifically required to do so by law. In the latter case, it becomes a hybrid pipeline. A hybrid pipeline would engage in both gas sale and purchase and gas transportation activities, as well as in any of the associated services. Hybrid pipelines are a particularly difficult case to regulate and to ensure competitiveness and non-... [Pg.296]

To the best of our knowledge, there have been few studies that deal with supply chain coordination where all agents involved adopt the satisficing objectives. This chapter attempts to fill this gap. The contractual forms we consider include WP, BB, and QF contracts. We focus these three contractual forms for three reasons. Firstly, they are popular contracts in business practice (Tayur, Ganeshan, Magazine, 1999). Secondly, they have been extensively studied in the supply chain literature, mostly in the framework of expected profit maximization (Cachon, 2003). Thirdly, WP, BB, and QF contracts have one, two, and three contract parameters, respectively. Hence, our research will answer the question if increased degrees of freedom in contractual forms will be beneficial to coordination of supply chains with the satisficing objectives. [Pg.234]

To assist companies in the make-buy decision it is normally necessary for companies to have a framework by which they can understand the opportunity costs and risks of insourcing or outsourcing activities. A formalised process will normally assess the current internal costs of ownership against the external costs of ownership. More advanced models may well try to understand deskilling, the loss of critical assets and post-contractual lock-in and moral hazard over time if activities are outsourced. [Pg.236]

Latent defects are defects or damages not revealed during assembly and commissioning. They occur only after acceptance during normal operation of the plant Unless latent defects are attributable to faulty operation of the personal, the plant manufacturer, within the framework of his defects liability, is liable to remedy defects at his own costs. However, clever contractual arrangements with his subcontractor wiU entitle the plant manufacturer to pass these defects and thus the related costs on to the subcontractor. [Pg.68]

These detail time schedules are subordinated to so-called framework time scheduling. Framework time scheduhng contains only the essential, i.e. contractually stipulated or penalty-related basic dates, as well as the beginning and the end of the project sections. Figures 4.3, 4.4 and 4.5 show examples of a framework time schedule, a time schedule for component procurement and for the commissioning. [Pg.97]

The operating conditions to be demonstrated within the framework of the test run/warranty run are either contractually stipulated or have to be subsequently agreed with the operator. In the majority of cases, the different loading conditions of the plant are shown and the guaranteed quaUties such as energy and live steam consumption as weU as product properties are measured. [Pg.182]

The WBS displays and defines the product to be developed or produced by hardware, software, support, and/or service element, and relates the work scope elements to each other and to the end product. The framework of the WBS defines all contractual authorized work it defines the work scope and assignments to the functional organizations responsible for performing the work. The WBS includes the levels at which required reporting information is summarized for submittal to the customer. An initial WBS is developed during the system acquisition proposal it is expanded and finalized after contract award. [Pg.453]

This section examines the importance of and evolution of ULP research laboratories contractual relationships. We mainly focus on non-EU contracts in the broadly defined chemistry domain. By non-EU contracts, we mean contracts negotiated outside any of the European Union framework programmes, i.e. all contracts signed between a ULP laboratory and an external private (e.g. a firm) or public institution. [Pg.152]

The need for contractual frameworks for larger works was mentioned previously. Some of the factors to be considered are listed below. Many of them apply to varying degrees to any level of work to be carried out regardless of size. It is up to the designer to determine the degree to which they should be considered. The factors include... [Pg.121]
