The distributor has notified the recipient that the recipient is engaging in an activity that is inconsistent with a personal protective equipment program set forth in a SNUR, and the distributor is aware of the lapse. In other words, the recipient is likely engaging in a significant new use. The distributor must submit that notice within 15 working days of the date it has knowledge of the activity. 

The recipient provides a written assurance that the recipient has implemented a personal protective equipment program and will take appropriate measures to avoid activities that are inconsistent with it. The distributor must receive this written assurance within 15 days of its original notice to the recipient. 

If the distributor receives information after the written statement of assurance, to the effect that the recipient is engaging in activities that are inconsistent with the personal protective equipment program, then the distributor must follow the stricter procedures in 40 C.F.R. 

STOP includes five steps, especially, decide, cease, observe, act and report. Firstly, observation time and point is decided. Secondly, stop near personnel observed. Thirdly, it is observation. C) Personal protective equipment to be used by employees for each of the site tasks and operations being conducted as required by the personal protective equipment program in paragraph (g)(5) of this section. 

Personal protective equipment programs. The purpose of personal protective clothing and equipment (PPE) is to shield or isolate individuals from the chemical, physical, and biologic hazards that may be encountered at a hazardous substance site. 

There are a number of cases on the Unfair Contract Terms Act and on the requirement of reasonableness. The cases must, however, be treated with caution for the decision in each turns on its facts and just because one case is decided one way it does not mean that all others will follow. One example is St Albans City and District Council v International Computers Ltd [1996] 4 All ER 481. The facts were that the council had ordered a computer system from ICL to enable them to compute the Community Charge for the forthcoming year. ICL insisted on using its standard terms and conditions which stated that its liability will not exceed the price or charge payable for the item of Equipment, Program or Service in respect of which liability arises or 100,000 (whichever is the lesser)... . Errors in the software and incorrect advice from ICL s project manager resulted in an overestimate of the population of the area, an undercharge of residents and a loss to the council of 1.3 million.
