The J 984 Federal Hazardous and Solid Waste Amendments (HSWA, pronounced "hiss-wa") to RCRA requires phasing-out land disposal of hazardous waste. GDC applies to all stationary sources (fixed facilities) that handle, produce, process, or store regulated substances or extremely hazardous substances (EHS)47. It obligates facilities to identify and safely manage all hazards, including reactive hazards. Similar to OSHA, EPA can use its GDC enforcement authority to create legally binding requirements or enforce actions for hazards that have not been properly identified or managed. 

The EPA GDC enforcement authority can be used in either a proactive (before an incident) or a reactive (after an incident) manner. EPA can use its order authority (CAA Section 112[r][9]) to enforce GDC in a case where it finds the possibility of imminent and substantial endangerment. EPA has used GDC order authority in only one situation for reactive hazards. 

CERCLA, or Superfund, was enacted in 1980, and amended in 1986, for the basic purpose of providing funding and enforcement authority to clean up any site where there is a past unremedied release of a hazardous substance or hazardous substance spill. Such sites are typically characterized as areas where hazardous waste or materials have been disposed of improperly, with litde if any responsible action being taken to mitigate the situation. Standards for financial responsibility were promulgated by the SARA of 1986 which further amended Section 9003 of RCRA and mandated that the EPA establish financial responsibility requirements for UST owners and operators to guarantee cost recovery for corrective action and third-party liability caused by accidental releases of USTs containing petroleum products.

The key distinction here is that patients neither were informed about nor consented to the tests, and that the hospital, a state institution, was ultimately using the results for law enforcement purposes. In other cases such as Chandler v. Miller (1997), the persons (such as employment applicants) took the tests voluntarily and knew their purpose. Also, the results were not turned over to law enforcement authorities. As a result, in those cases the interest in minimizing the harm brought about by drug abuse could be balanced against the rights of the persons being tested. 

In Ferguson v. City of Charleston, the U.S. Supreme Court declares that forcing pregnant patients in a state hospital to take drug tests and turning the results over to law enforcement authorities violated the Fourth Amendment. The U.S. Supreme Court rules that use of infrared imaging systems to search for evidence of a marijuana-growing operation in a home violates the expectation of privacy provided for in the Fourth Amendment. 

Despite the removal of compositional legislation, the descriptions of dilutable soft drinks in the United Kingdom are still widely used today. Consumers and enforcement authorities alike still have an expectation that a product described as a squash will be a cloudy product containing a significant proportion of fruit juice. Similar expectations still apply to the other products mentioned above. 

Considerable international effort has since been directed towards these goals and substantial progress has been made in a number of directions. The development of accepted detection procedures not only gives enforcement authorities the ability to check that products are correctly labelled but also gives the consumer confidence that adequate independent controls are available. Perhaps the detection method that is, to date, the most internationally accepted is Electron Paramagnetic Resonance (EPR) spectroscopy which can also be referred to as Electron Spin Resonance (ESR) spectroscopy.
