Effective Dates

All sources subject to the permit program must submit a complete permit application within 12 months of the effective date of the program. The state permitting authority must determine whether or not to approve an application within 18 months of the date it receives the application. 

Temporary variance An OSH A variance issued to an employer who is unable to comply with a standard by its effective date for reasons beyond their control. The employer must demonstrate a plan for coming into compliance within a period not to exceed one year and provide all available measures to protect the employees in the interim.

But an ideological shift in Congress disrupted this process. In the 104th Congress, industrial opponents of appliance efficiency standards found sympathetic support, and passed a one-year moratorium on appliance efficiency standards in 1995. The moratorium held back DOE efforts on appliance standards for nearly two years. The refrigerator standard that was to be issued early in 1995 was delayed until 1997, and the effectiveness date set hack three years until 2001. Progress toward new standards on ballasts, water heaters, air conditioners, clothes washers, and other products was delayed.

National capacity variance When developing a treatment standard, U.S. EPA examines the available treatment capacity to determine whether it is sufficient to handle current and future waste management needs. If U.S. EPA determines that nationally there is not enough capacity to treat a waste, it can automatically extend the effective date of the waste s treatment standard. Such an extension to the effective date is intended to give the waste treatment industry more time to develop the capacity to handle the waste. Wastes under a national capacity variance can be disposed of, without meeting the treatment standards, in landfills and surface impoundments that meet minimum technical requirements (e.g., liners, leachate collection and removal systems, and leak detection systems). 

Case-by-case extensions A facility may petition U.S. EPA for a case-by-case extension to delay the effective date of a waste s treatment standard upon showing that capacity does not exist for that particular waste. Similar to national capacity variances, wastes granted case-by-case extensions can be disposed of without meeting the treatment standards in landfills and surface impoundments that meet minimum technical requirements. 

The risk assessment has also concluded that a level of 200 mg/kg for lead in the soil will be a protective level for expected site exposures along with an excess cancer risk level for TCE-contaminated soil (56 pg/L). Based on investigations of activities at the site, the TCE-contaminated soil has not been determined to be a listed RCRA hazardous waste, as the cleaning solution records indicate the solution contained less than 10% TCE. However, the lead-contaminated soil is an RCRA hazardous waste by characteristic in this instance due to extraction procedure (EP) toxicity. None of the waste is believed to have been disposed at the site after November 19, 1980 (the effective date for most of the RCRA treatment, storage, and disposal requirements). 

The requirements for interim status incinerators are very similar to the already discussed regulations for permitted units. The interim status regulations, however, are designed to be self-implementing as the facilities are already in operation on the effective date of the standards. Table 23.2 compares the requirements for permitted and interim status incinerators. 

In addition, the trial bum process for interim status incinerators is different from that discussed previously in this chapter. As interim status units were already in operation on the effective date of the regulations, the facility would submit their trial bum plan for approval without ceasing operation. Once this plan is approved, the facility would conduct the trial bum test (or submit data in lieu of the trial bum) and continue operating under interim status until the final permit is issued.

When a new SOP is to be written or when an outdated one is to be revised, some very important protocols must be considered. First, the scientists who will be conducting the work must be involved. Second, a standard format must be followed so that all SOPs look alike and provide information the company employees and laboratory auditors expect. The format typically includes a document number, a descriptive title, a revision number, an effective date, a statement of purpose, a statement of scope, the procedure itself, references (such as the...

The effective date of the GLP regulations was June 20, 1979. The regulations did not apply retroactively, therefore studies begun and completed prior to the effective date were not required to comply with the GLPs even if submitted to... 

FDA on or after June 20, 1979. For studies in progress on June 20, 1979, only those portions of the study done on or after June 20 were required to be done in compliance with the regulations. Of course, those studies initiated on or after the effective date were to be done in full compliance with the GLPs. 

The historical file of SOPs documents what SOPs were in effect at any time during a laboratory s history. Because FDA inspection of a study often occurs years after the completion of that study, the historical file of SOPs will be of special use to an FDA inspector. Including the effective date on the SOP itself will aid in maintenance of the historical file and will also make it easier to ascertain if any one SOP manual contains the current version of any individual SOP. Accessory documentation of effective dates (e.g., in the transmittal memo for the distribution of SOPs) is permissible but not recommended.
