CWA to establish the minimum level of control to be required by a permit. They are the Best Practicable Control Technology (BPT), Best Available Technology Economically Achievable (BAT), Best Conventional Pollutant Control Technology (BCT), Best Available Demonstrated Technology (BDT), and Best Management Practices (BMPs). Industries that do not discharge directly into surface waters but into publicly operated treatment works (POTWs) are subject to pretreatment standards under Section 307(b) of the CWA. 19.3.1.3 Permit Program [Pg.1294]

An NPDES permit can be issued by EPA or by a state that has received EPA permitting approval. As of 1996,40 states and territories had received EPA s approval. States and territories that are not authorized to administer the NPDES program are Alaska, Arizona, District of Columbia, Idaho, Louisiana, Maine, Massachusetts, New Hampshire, New Mexico, the Pacific Territories, Puerto Rico, and Texas. For these states and territories, the 10 EPA Regional Offices will issue and administer the NPDES permits. The permit process is elaborate and requires extensive information and numerous steps. First a number of forms need to be completed to provide information about the facility, its operation, and the nature of the discharges. This is followed by a period of discussion between EPA and the discharging facility, and the draft permit is announced for comments from the public for 30 days. Once the comments are reviewed, responded to, and implemented, then the final NPDES permit is issued. [Pg.1294]


Entry into Confined Spaces. In 1993 OSHA adopted a confined space entry rule (93) requiring employers to evaluate the workplace to (/) determine if it contains any confined spaces, (2) mark or identify such confined spaces, and (2) develop and implement a permit program for entry into such spaces. The program must include a permit system which specifies the steps to be taken to identify, evaluate, control, and monitor possible electrical, mechanical, and chemical ha2ards select and use equipment institute stand-by attendance and estabflsh communications. As mentioned, nonattainment areas will have to implement different control measures, depending on their classification. Marginal areas, for example, are the closest to meeting the standard. They will be required to conduct an inventory of their ozone-causing emissions and institute a permit program. Nonattainment areas with more serious air quality problems must implement various control measures. The worse the air quality, the more controls areas will have to implement. [Pg.398]

Each permit issued to a facility will be for a fixed term of up to 5 years. The new law establishes a permit fee whereby the state collects a fee from the permitted facility to cover reasonable direct and indirect costs of the permitting program. [Pg.403]

Although many limits are implemented at the state level, there are national guidelines that serve as a basis for more specific limits. Sources that are considered major under the CAA are subject to prevention of significant deterioration (PSD) or new source review (NSR). Initially, all major sources of air pollution are required to obtain an operating permit. However, any state permitting authority may extend the applicability of the operating permit to minor sources as well.
