Sub-contractors

The industry is increasingly acknowledging the value of oontractors and service companies in improving their individual core capabilities through alliances, i.e. a joint venture for a particular project or a number of projects. A lead contractor e.g. a drilling company may form alliances with a number of sub contractors to be able to cover a wider spectrum of activities e.g. completions, workovers and well interventions. 

With large power installations of 40 to 50 thousand horsepower compressing flammable gases, this is not usually possible, and each individual item has to be separately tested. A typical situation could be a 40 thousand horsepower gas turbine driving multibody process gas compressors, where the engineering and manufacture involve one contractor and six sub-contractors located in the UK, U.S.A., Japan, and Indonesia. The difficulties of separately testing each sub-unit to ensure compatibility will be compounded by distance and culture. 

Although we will be providing the site and site location, we will not be identifying prime contractors or sub-contractors. 

The process of engaging the required capabilities must be a formal process so that both the organization in need and the contractor/sub-contractor are protected in the event of a failure to perform, an accident, or a difference of opinion as to terms or performance. Adherence to the provisions of this procedure will help attain good contracting practices and minimize the potential liabilities to the host organization in contractual relationships. 

Main and nominated supplier. The client may wish a certain firm to supply materials for the contract, which may be for installation by the main, or a sub-contractor. 

Principal contractor with domestic sub-contractor and supplier. The expression domestic does not necessarily infer housing, although housing contracts can be carried out in this manner. A domestic sub-contractor is a contractor who is appointed by the principal contractor. The client has no relationship with a domestic sub-contractor, unless he interferes with his selection such that the appointment becomes nominated. This type of appointment has become very common. 

A nominated subcontractor has no contractual relationship with the client, but the case of Junior Books V. Veitchi (1982) placed an almost contractual duty upon the nominated sub-contractor. Where a separate agreement has been signed between the client and nominated sub-contractor then a direct contractual relationship applies. Problems can arise where a main contractor says that his nominated sub-contractor or supplier is delaying him. 

Because the client has instructed him to use a firm which was not of his choice, the main contractor could claim damages in the form of loss and/or expenses from his client. Where the principal contractor has brought in his own domestic sub-contractor, then he is responsible for his actions. That is the main reason domestic subcontracts have become popular. The client must decide upon which trade will become the main contractor. In building matters, it is usual for the main contractor to be a firm who can carry out the most substantial works, and this will be a general building firm. Some general building firms carry their own mechanical and electrical departments, which reduce the need for sub-contractors. 

There are occasions when it is more appropriate to appoint a mechanical or electrical firm to be the main contractor. An example would be the laying of a district heating mains, where the largest value and complexity is in mechanical engineering. However, experience shows that not all specialists are geared to this role, and this can cause problems, especially from a main contractor who is more familiar with the role of sub-contractor. Overall, it is recommended that the main contractor be a building or civil engineering firm, unless those works are very small.

Where nominated suppliers or sub-contractors are involved, the main contractor has the opportunity to voice his opinion of those selected by the client. 

There are generally two kinds of site meetings. One is where all parties are present and the other is where the professional team meets with the main contractor and then the main contractor organizes his own contractors meeting with his sub-contractors. The job itself will determine the kind of site meeting to be held. Ad hoc meetings... 

The value of having one contractor to control the progress of the work can be seen where there are several contractors on a site at different periods. Progress can suddenly come to a halt if a key contractor does not comply with an agreement. For example, if the electrical sub-contractor does not provide a temporary electrical supply, there may be no light and power, causing other contractors to be delayed. 

An installer may even inadvertently toss away warranty information that comes with a piece of equipment. In one such case, an air conditioner broke down less than one year after installation. It took phone calls to the designer, the general contractor, and the sub-contractor to get matters straightened out. Meanwhile, the July weather was getting hotter by the day. 

Mark Phillips openly admits to his involvement in some aspects of mind control research with the Yerkes Primate Center in Atlanta, Georgia, in the late 1960 s. Debunkers may automatically cry he is some kind of misinformation specialist because of this, but there is more to consider. There are many sub-contractors to the Department of Defense (DOD) in mind control research and Phillips is another one of them with a high level clearance. Perhaps we should listen first and judge later. 

This observation is however not restricted to supposedly conservative factory owners, who at best fear liability problems or financial risks. It applies to workers and technicians alike, to purchasing department and management, to associations and scientific branch institutes as well as to sub-contractors of machinery, components and anxiliary eqnipment, in which the chemicals are nsed. This conservative stance applies not only with regard to enviromnent and health-related iimovation, bnt also to innovation in general and it is amplified (and also repeatedly npset) by the stress of globalisation and social uncertainty. 

Neither Party may assign its rights imder this Agreement or any part thereof without the prior written consent of the other Party and neither Party may sub-contract the performance of all or any of its obligations under this Agreement without the prior written consent of the other Party. Any party who so sub-contracts shall be responsible for the acts and omissions of its sub-contractors as though they were its own. 

Another high energy and environment friendly oxidizer which has recently come to prominence as a result of painstaking research at the European Space Agency (Aerospace Propulsion Products Division) and its sub-contractors (TNO-PML,... 

On 19 March and 24 April 1941, the TEA [Technische Ausschufi der I.G. Farbenindustrie AG Technical Committee] decided upon the details of production in Auschwitz. Two factories were to be created, one for synthetic rubber (Buna IV) and one for acetic acid. In the meantime, and in addition, I.G. Auschwitz assured itself of its own coal supplies, from the Fiirsten mine and Janina mine. Both mines were operated using Jews. ... 

Manage and monitor the performance and quality of sub contractors as well as their own performance. 

Figure 4 shows that at June 30, 1985 on-site construction was essentially complete and ahead of schedule. Peak on-site sub-contractor labour force numbered about 1,800. Performance on the site was most satisfactory and only 2.5 percent of the budgeted time was lost due to industrial disputes. The performance factor (PF) of the workforce over the construction period was 0.83 compared to a budgeted PF of 1. It is to be noted that the lower the PF the more productive is the workforce. 

Transport incidents the figures given for uncontained spills include seven transport incidents involving sub-contractors. A transportation service agreement (that includes H SE targets) is in place with the Finnish State railways, and Neste only owns ships with double hulls or bottoms. Specific mention is made of training for road tanker accidents. 

Fatalities three fatalities occurred during 1998. Two involved employees (one in France and one in China), and the third involved a sub contractor in Brazil. 

Supplier involvement the CER identifies the use of audits, discussions, training days and of binding guidelines for sub contractors, as examples of the commitment Wacker gives to applying the same environmental and safety standards to suppliers and sub-contractors working at its production sites. 

The generating plant was ordered under the same contract as that at Tunnel Quarry. There were a number of special conditions to the contract which are interesting to recall, bearing in mind that the contractor was only being asked to supply their standard product. Only British workmen were to be allowed to work on the manufacture and installation of the plant, and only British or Empire materials were to be used. No duplicates of any drawings were to be produced, and all annotations describing the function of the various parts were to be erased, even on drawings issued to sub-contractors. Final assembly of the complete equipment was to be undertaken in a comer of the factory securely screened off from the rest of the works. 

Any sub-contractor concerning manufacture, packaging and control must be formally notified by the Responsible Pharmacist to the competent departments of the Ministry of Health. 

When the servicing and maintenance of the manufacturing and control equipment, sterilization equipment, air conditioning systems, computerized systems, etc. are carried out by a sub-contractor, the contract giver must verify that the chosen sub-contractor really has at his disposal the appropriate means (equipment, qualified staff,... 

Sub contractor - a general or specialty contractor who works for another general contractor. 

Based on Section B.4 on Review Procedure, BTP-14 of SRP Chapter 7, document reviews are required to ensure that the software of GE and his sub-contractors meets the acceptance criteria as defined in Section B.3 Acceptance Criteria, BTP-14 of SRP Chapter 7. 

Site visits are conducted during each phase. A minimum of 30 site visits is planned to GE and his sub-contractors. The objective of the site visit is to observe and obtain objective evidence that programs, policies, and procedures are being appropriately applied.
