Cooling Water System. A list of cooling duties will be available at this point so the cost estimate for this system can be factored or estimated based on a similar operating system. For a more definitive estimate based on initial or detailed layout, it is probably best to use a contractor or consultant skilled in these designs. If a cooling tower is involved, the groundwork will already have been set. This basis can be passed along on specification sheets provided in the Appendix to a vendor for quotes. [Pg.228]

Contractors and subcontractors are typically required by contract to be responsible for their own workers and should provide a level of oversight to meet all specifications. The primary contractor who is responsible for the worksite typically establishes the minimum requirements, controls access to the worksite, and verifies that subcontractors fulfill their health and safety duties and responsibilities. Wlien these specifications are defined, all contractors and subcontractors should meet or exceed these requirements, as appropriate. This could be based on the nature of the assigned tasks and associated hazards [2]. [Pg.29]

A nominated subcontractor has no contractual relationship with the client, but the case of Junior Books V. Veitchi (1982) placed an almost contractual duty upon the nominated sub-contractor. Where a separate agreement has been signed between the client and nominated sub-contractor then a direct contractual relationship applies. Problems can arise where a main contractor says that his nominated sub-contractor or supplier is delaying him. [Pg.91]

The contractor is under a duty in contract to provide and install plant which is of merchantable quality. There is no duty on the client to ensure how the contractor carries out those duties, although his client can sue the consulting engineer in negligence, if he is not diligent in detecting faulty workmanship, such that he suffers loss as a result. [Pg.93]

In a lump sum contract the contractor does not have a common law right to interim payments. Most larger contracts have an express term within them giving the right to interim payments, or payments on account, notwithstanding that they have not fulfilled their contractual duties in completing the works. The essence of a plant engineering contract will be that the plant actually performs to the criteria laid down in the design, and this must be established before a Practical Completion Certificate is even considered. Tests will need to be made to the plant, and then it will be commissioned by the contractor and left in a condition whereby it can be operated as specified. When the work within the contract is complete, a certificate should be issued by the client (or employer) to the contractor. Some large organisations lay down in general terms the numbers of inspectors and how they require the work to be inspected.
