Another form of misappropriation is the disclosure or use of a trade secret of another without consent, by a person who used "improper means" to acquire knowledge of the trade secret. "Improper means" generally include theft, bribery, misrepresentation, breach or inducement of a breach of a duty to maintain secrecy, or espionage.

In addition, the DoE proposed EQSs in a 1991 consultation document for those pesticides on the Red List (the UK s original priority hazardous substances list). Although non-statutory, the Government is committed to the reduction of Red List Substances discharging to the North Sea and the NRA uses the standards to assess the effects of these substances on the environment and to derive consents for point source discharges of these compounds. Failures for agricultural pesticides are rare.

Sometimes a compromise in the quality of the inputs (perhaps due to non-availability of a particular component to the required specification) may be necessory to avoid a production delay. Similar constraints in the design or process may also make it necessary to have a deviation in design, without undermining the quality requirements. The ISO emphasizes that, for such deviations, written authorization from a competent authority, and preferably also the written consent of the customer, is essential before implementing sueh a change. This will be for a specific period and for a specific number of items.

NATIONAL RIVERS AUTHORITY WATER RESOURCES ACT 1991 - CONSENT TO DISCHARGE... 

The National Rivers Authority, in pursuance of its powers under the above mentioned Act, HEREBY GIVES CONSENT to the discharge described hereunder subject to the terms and conditions set out below. 

This consent shall not be taken as providing a statutory defence against a charge of pollution in respect of any poisonous, noxious or polluting constituents not specified herein. 

Ail the parameters on which various consents (or permissions to dispose of, waste streams) are based must be reliably measured and recorded. This is easier to achieve with gaseous emissions (Chapter 10) and liquid effluents than with heterogeneous solid wastes.
