Enforced mechanism

As with the very small fraction of these chemicals that are essential to our health, it appears there are ranges of exposure to all these chemicals that, while probably not beneficial to health, are probably without detrimental effect. And, for all of them, both the industrial ones and those of strictly natural origin, there are ranges of exposure that can put our health into jeopardy. These facts bring out one of the most important concepts in toxicology all chemicals are toxic under some conditions of exposure. The toxicologist attempts to understand what those conditions are. Once they are understood, measures can be taken to limit human exposure so that toxicity can be avoided. Of course the latter can be achieved only if societies have appropriate control and enforcement mechanisms in place. 

Consideration was also given to the publication of GLP guidelines rather than regulations. While this would have provided the testing facilities with standards of conduct, it would not have given the agency an enforcement mechanism to ensure that the standards were met. 

This authority includes the right of FDA to ask for reports on experience with a drug s use and provides for stiffer enforcement mechanisms. The DRRA also authorizes the establishment of a National Center for Clinical Pharmacology (NCCP) as part of HEW. 

For this purpose, an institution can be defined as a rule-enforcing mechanism. The rules govern the behavior of a well-defined group of persons, by means of external, formal sanctions. The implied contrast here is to social norms, which enforce rules by external, informal sanctions, and to internalized rules. A policeman may fine me if I liner in the park. If there is no policeman around, other people may glare at me. If there are no other people around, my own conscience may be sufficient deterrence.

Another component in postmarketing safety surveillance programs is the establishment of enforcement mechanisms to correct product problems. Errors can occur in drug production, packaging, and shipping that lead to adulteration, loss of potency, mislabeling, and other hazardous situations. Prompted by user reports or by results of their own internal quality control procedures, drug manufacturers routinely initiate voluntary product recalls. These actions typically involve limited quantities, or batches, which are cited in public notices of recalls published by the FDA. Product problems that represent serious and widespread threats to public health evoke another form of official publication Public Safety Alerts (entitled Public Safety Reports in Europe). 

Questions of liabilities were critical to the development of Part IIA, not only to ensure that the resulting regime delivered an effective enforcement mechanism for regulators to use, but also to reassure stakeholders that any liabilities they might face would be reasonable, fair and predictable. 

While EPA has the authority to prosecute importers and exporters for failure to comply with the requirements of TSCA 12 and 13, the Customs Service has the concurrent jurisdiction to detain inbound shipments not in comph-ance with 13. States have 1 year to send the USEPA a list of systems with a history of significant noncompUance and 5 years to report on the success of enforcement mechanisms and initial capacity development efforts. State primacy agencies must also provide progress reports to governors and the public. 

The Universal Declaration is very much broader and asserts a much larger set of rights than the European Convention. However, there is no mechanism for enforcing the Universal Declaration while the European Convention establishes the European Court of Human Rights specifically to provide a final enforcement mechanism.
