Communication provisions

In the absence of any Community provisions in this area and without prejudice to the Commission s right of initiative in proposing such provisions, it is for each Member State to formulate the policies, measures and instruments it wishes to adopt in order to comply with the targets set under the Kyoto Protocol. 

Definitive information about the clinical effectiveness of DHA is important both for the patients and their families and for the scientific community. If any relevant Community provisions relating to waste exist, these should be referred to. In their absence, it is helpful to mention that national or regional provisions may be in force. 

Furthermore, the employer is required, to use or to provide only work equipment and protective devices which are in compliance with the European Community provisions on design, manufacture, and supply with respect to health and safety. This includes consistency with the provisions of the EU directive 94/9/EC [6-23] dealing with equipment and protecting systems intended for use in potentially explosive atmospheres, and consistency with the existing European technical standards.

When there are no specific Community provisions for safety of a product (i.e., EU laws and standards), a product may be deemed safe when it conforms to the specific rules of national law of the member state (i.e., national laws and standards). In the absence of Community and national rules for safety, then conformity may be based on national standards that are equivalent to a European standard or, where they exist, to Community technical specifications, or, failing these, member state standards or codes of good practice in the sector concerned or to the state of the art and technology to the safety that consumers may reasonably expect [see Standards in Chapter 3].

Article 234 (formerly 177) provides that any court or tribunal may ask the European Court for a ruling but only the final court of appeal (the House of Lords in the UK) must ask for a ruling if a party requests it. In the English case of Bulmer v. Bollinget the Court of Appeal held that the High Court and the Court of Appeal may interpret Community law. 

Specific advisory groups could be established, where appropriate, to oversee the process. These could include members of the governing body, local agencies and community provision.

Many of the requkements for copyrightabiUty may be gleaned from this provision. 

A plan is more than a list of goals, a bar chart, or a schedule of activities. For the business plan to be effective it needs to define how the measures it covers are to be achieved and the resources to achieve them obtained. There may well be supplementary plans for this purpose. The plan or plans also need to define who is to be responsible for achieving the goals and implementing the plans. Once this is done and the provisions communicated to those affected, a method of tracking achievement can be put in place. To track performance effectively the implementation of the plan needs to be phased such that target dates are set for the determination and acquisition of resources, the issue of detail implementation plans, the organization of work, and the completion of individual tasks.

Provisions for primary and emergency communications (internal and external telephone links and radios) require careful assessment. If there is a flammable hazard on site, radios may need to be intrinsically safe or flameproof. 

Management must institute procedures to assess levels of compliance with agreed standards for safety. Techniques include environmental and/or biological monitoring, health surveillance, safety audits, safety inspections, and procedures for accident reporting, investigation and analysis. Communication is essential, e.g. by provision of information (on specific chemicals, processes, etc.), safety meetings, notices, safety bulletins etc. 

The EU laws follow three principles related to consumer health (1) protection, (2) fraud prevention, and (3) trade barriers. The union tried to harmonize the laws of different countries, particularly in recent years when the enlargement of the European Community became dynamic. Color Directive 94/36/EC contains horizontal provisions that refer to common laws in different countries and vertical directives that apply to specific foods. The EU directives take into account the recommendations of the Scientific Committee for Food (SCF), the Codex AUmen-tarius Commission, and the Joint Food and Agriculture OrganizationAVorld Health Organization (FAOAVHO) Expert Committee on Food Additives (JECFA).
