Prior to 1960, an injured plaintiff seeking recovery in a products HabiUty action could bring a case under either of two theories. The plaintiff could allege that the product seller was negligent, or that the seller breached a warranty that attended every product sale provided for under the Uniform Sales Act and, later, under Section 2-314 of the Uniform Commercial Code (UCC), which stipulated that for a product to be merchantable it must be "reasonably fit for the ordinary purposes for which such goods are used." Each of these theories came with a distinct disadvantage. 

Manufacturers, depending upon market needs, may adopt all or a few such designs or even have their own designs, still conforming to such stipulations. Special applications may, however, call for a custom-built motor as noted later. The corrective action requirements fail to stipulate when corrective action should be taken except to say that they shall be to a degree appropriate to the risks encountered. There is no compulsion for the supplier to correct nonconformities before repeat production or shipment of subsequent product. However, immediate correction is not always practical. You should base the timing of your corrective action on the severity of the nonconformities. All nonconformities are costly to the business, but correction also adds to the cost and should be matched to the benefits it will accrue (see later under Risks). Any action taken to eliminate a nonconformity before the customer receives the product or service could be considered a preventive action. By this definition, final inspection is a preventive action because it should prevent the supply of nonconforming product to the customer. However, an error becomes a nonconformity when detected at any acceptance stage in the process, as indicated in clause 4.12 of the standard. Therefore an action taken to eliminate a potential nonconformity prior to an acceptance stage is a preventive action. This rules out any inspection stages as being preventive action measures - they are detection measures only. 

Project-research, a method of organizing research by stipulation of projects and allocation of these to individuals or teams of scientists in separate laboratories, was developed in the United States during World War I in research on chemical warfare. This research was initially conducted largely by academic chemists as volunteers and later by them in the Research Division of the Chemical Warfare Service of the U. S. Army. Many of the leading American chemists in the 1920s shared the common experience of research on chemical warfare. A validated method (No. 63) for the analysis of benzoic acid, sorbic and para-hydroxybenzoic acids in fruit juices has been published in the IFU handbook (Anon, 1995e). In this method the resolution takes place on a C8 reverse-phase column. With this solvent system (methanolic/ammonium acetate, pH 4.55) sorbic and benzoic acids elute quite quickly and the less polar para-hydroxybenzoate esters elute much later. The decisions on building the current NPPs in Finland were made in late 1960 s - early 1970 s. At that time, the prospects for nuclear energy were very promising and spent fuel was regarded as an asset due to the worth of its plutonium and uranium as nuclear fuel. Accordingly, the contract for the supply of the Loviisa NPP included clauses for the return of spent fuel to the supplier of the fresh fuel in Soviet Union. Though no such stipulations included in the supply contracts for the Olkiluoto NPP, it was taken obvious that the operator would later make contract with a French or British reprocessing company. 

Stipules.—Stipules are lateral leafy or membranous outgrowths from the base of the petiole at its junction with the stem. They may be divided into two groups, viz. lateral and axillary. The lateral group includes four types, namely, free lateral, lateral adnate, lateral connate and lateral interpetiolar. 

Free lateral stipules are seen in Leguminosce, Rosaceoe, Beeches, etc. They are free on either side of the petiole and supplied by vascular tissue from the petiolar bundle mass. In appearance and duration they may be either green, foliaceous and persistent or membranous to leathery, scale-like and caducous. Caducous scaly stipules only function as bud scales through the winter and fall in spring as the buds expand. 

Lateral adnate stipules are such as fuse with and are carried up with the petiole as wing-like appendages. This t3 e is seen in the genus Rosa, in Clovers, etc. 

Lateral connate stipules are such as join and run up with the petiole to form a structure which is called a ligule. This structure is common to the Graminese or Grass family.

Efifect of priority right. According to the Paris Convention, a person who has filed an earlier application in any state which is party to the Paris Convention may claim for a later filed application for the same invention priority from the date of filing of the earlier application. As a result, the date of filing of the earlier application becomes the effective date of filing of the later application, if this later application is filed in a state party to the Paris Convention. This is also stipulated in Article 87(1) EPC.
