Legal requirements policy

There are many regulations governing the transportation of chemicals, and any evaluation of transportation risks and options must include consideration of those regulations. In addition, some companies have policies that require going beyond legal requirements for specific materials. 

Whereas the Health and Safety Commission is responsible for the development of policies in the health and safety field, the Health and Safety Executive, being a separate statutory body appointed by the Commission, will work in accordance with directions and guidance given by the Commission. The Executive will provide advice on health and safety to both sides of industry and will enforce legal requirements.

Regulatory officials nevertheless act on the basis of such hypothetical risks ( hypothetical definitely does not mean imaginary it means that the risk estimates are based on certain scientific hypotheses and that they have not been empirically tested). Such actions are in part based on legal requirements (Chapter 11) and in part on the prudence that is a traditional feature of public health policies. National allocation plans will constitute State aid under Article 87(1) EC and will therefore have to be notified to the Commission for assessment under State aid rules. Any form of activation - whether in the sense of a comprehensive strategy (and its ultimate acceptance), or the implementation of a bundle of measures (motivated by social policy) or individual measures - aimed at creating specific preconditions for employment promotion, as well as the concrete realisation of these aims, will be subject to overall legal requirements.

The argument put forward here is that die promotion of organic agriculture requires policy instruments in addition to those based on legal regulation and economic incentives. Other social mechanisms have to be considered and they may involve several types of communication between public administration, farmers and organisations and firms within the field of agriculture and food production/consumption.

Compliance goals and incentives in companies are often of the negative sort, such as penalties for failures to comply with legal requirements. This is not surprising in that compHance failures can lead to serious penalties for the company. But, just as the government, in its policies of the last decade, began to use a carrot approach as well as a stick approach with companies, companies should in turn also use a carrot approach with employees. 

An employer is not required to return a driver to safety-sensitive functions because he/she met the return-to-duty requirements. This will be based on company policy and other legal requirements.
