Hazardous Materials Transportation Act

The Hazardous Materials Transportation Act, passed in 1975, is the primary law governing transportation of chemicals and hazardous materials. The act includes a comprehensive assessment of the regulations, information systems, container safety, and training for emergency response and enforcement. The regulations apply to any person who transports, or causes to be transported or shipped, a hazardous material or who manufactures, fabricates, marks, maintains, reconditions, repairs, or tests a package or container which is represented, marked, certified, or sold by such person for use in the transportation in commerce of certain hazardous materials.  [Pg.146]

Under this statutory authority, the Secretary of Transportation has broad authority to determine what constitutes a hazardous material, using the dual tools of quantity and type. By this two-part approach, any material that may pose an unreasonable risk to human health or the environment may be declared a hazardous material. Such a designated hazardous material obviously includes both the quantity and the form that make the material hazardous. [Pg.146]

The basic purpose of HMTA is to ensure safe transportation of hazardous materials through the nation s highways, railways, and waterways. The basic theme of HMTA is to prevent any person from offering or accepting a hazardous material for transportation anywhere within this nation if that material is not properly classified, described, packaged, marked, labeled, and properly authorized for shipment pursuant to the regulatory requirements. [Pg.146]

Under the Department of Transportation (DOT) regulations, a hazardous material is any substance or material, including a hazardous substance and hazardous waste that is capable of posing an unreasonable risk to health, safety, and property when transported in commerce.
