An ever-expanding list of occupational and environmental laws and regulations affect schools and colleges. The corresponding responsibilities require school administrators and staff to not only be aware of the various hazardous chemical regulations, but also to expend substantial time and dollars to assure that liabilities are minimized. Compliance with many of these regulations can be simplified, or at least, effectively focused and prioritized, if hazardous chemical and product information is readily available (Forum for Scientific Excellence, 1990).

Environmental laws and regulations including permits are reviewed in this chapter. Included are the Federal Clean Air Act Amendment (CAAA), the Federal Clean Water Act (CWA) regulations, the Resource Conservation and Recovery Act (RCRA) or, as it is also known, the Solid Waste Disposal Act. Also discussed along with the regulations under OSHAare the National Institute for Occupational Safety and Health (NIOSH) and the Hazardous Waste Operations and Emergency Response (HAZWOPER). 

The environmental regulations covered here are not intended to be all-inclusive but to provide a basic understanding of the impoitant environmental laws and regulations. 

MGC/PLASMOX developed a portable unit, Model RIF 2, that was put into operation in 1994 and has since built additional units. The RIF 2 is skid-mounted and designed to be moved by four standard tractor-trailers. The unit has been used in Europe and is permitted under both Swiss and German environmental laws and regulations. It was used successfully to destroy chemical agents for the Swiss Army at its chemical materiel laboratory in Spiez, Switzerland. The PLASMOX tests run by the Germans and Swiss indicate that the system will destroy chemical agent safely and rapidly (Bums and Roe, 2001). 

Hazardous waste problems permeate our society. Potential threats to human health from pollutants in the environment arouse great social and scientific controversy. Social concern has led to numerous environmental laws and regulations such as the Resource Conservation and Recovery Act of 1976 and amendments of 1984 (RCRA) and the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 and its 1986 amendments (CERCLA). RCRA addresses current waste by requiring stringent record keeping of all waste production, collection, treatment, storage, and disposal activities. CERCLA, or Superfund, addresses the cleanup of hazardous waste sites in the U.S.A. Out of about... 

AR 50-6 also defines requirements for management of RCWM. The regulation specifies that emergency on-site destruction of chemical munitions may be considered an option to reduce risk and that non-emergency on-site destruction is subject to CERCLA or RCRA. Also, AR 50-6 indicates that soil suspected of contamination by chemical agents or industrial chemicals is presumed hazardous until confirmed otherwise by laboratory analysis and is required to be managed in accordance with environmental laws and regulations.

Solvent releases can affect the quality of air, water, and soil which can then have adverse effects on human health and the enviromnent. More stringent environmental laws and regulations have been established to control their utilization and ensure a safer and healthier environment and a sustainable future. They are placing greater emphasis on the elimination or reduction of such releases at the source and the preservation of limited natural resources. However, replacing offensive solvents requires a comprehensive assessment of their overall environmental impact. This will ensure that substitute chemicals will not impose more stress on our environment and human health by transferring the problem to other media. 

This chapter was intended to provide a bird s eye view of key environmental laws and regulations for solvents. This chapter will not serve as a replacement of the laws discussed herein. 

The enterprise identifies safety and environmental impacts associated with system implementation. Applicable environmental laws and regulations should be identified, and the enterprise should ensure that these are complied with by any alternative solution. The enterprise completes an environmental impact and safety analysis to determine the impact on and by system products, and the impact of their life cycle processes on the environment, or to personnel. Use of materials, or generating by-products, which present a known hazard to the environment, are to be avoided to the extent feasible. Where not feasible, provisions must be provided for proper handling, storage, and disposal of hazardous materials or by-products. Results of these analyses influence trade-off analysis recommendations and assessments of system effectiveness.
