A request for reexamination may be made by the patentee, a third party, or the Commissioner of the Patent and Trademark Office whenever a new question of patentabiUty arises. This new question of patentabiUty has to be raised in the form of a pubHcation such as a journal article or a patent which was not considered during the prior prosecution. Reexarnination is a more expedited and economical means of receiving a judgment on whether or not a patent is vaUd in advance of Htigation.

The FDA is headed by the Commissioner of Food and Dmgs. Prepare and file the patent application documents. This document is called a specification. The specification must be clear enough so that anyone skilled in the subject matter of the invention could recreate your invention and use it. In the written portion of the specifications the inventor must slate the claims of the invention. These claims must show that the invention is novel and unobvious. Also, where applicable, illustrations must accompany the specification. There are filing fees for patent applications and if the application is successful there are maintenance fees to keep the patent in force. It helps us with public perception, it helps us in the political arena, and it helps us operate our plants better. And to their great credit, the NRC commissioners have shown the necessary leadership to reform the regulatory process. 

The third invention reported by the authors [19] was related to sulfur oxidation, but the invention was not patented. It was only registered with the Statutory Invention Registration (SIR). What this means is that, it is not a utility patent as the rest of the documents considered in this Chapter, rather a SIR registered document containing the specification and drawings of a provisional application filed for a patent, which has not been subjected to examination yet. It is issued by the PTO, if the applicant, among other requirements, waives the right to receive a patent on the invention within such period as may be prescribed by the Commissioner. The invention such as this, on which a statutory invention certificate is published, is not a patented invention for most purposes.
