Americans with Disabilities Act

We may not imagine how onr lives could be more frustrating and complex—but Congress can. [Pg.83]

Congress does from a third to a half of what I think is the minimum that it ought to do, and I am profoundly grateful that I get as much. [Pg.83]

The Americans with Disabilities Act (ADA) has opened another market for scrap tires in resilient playground surfacing. Many schools and recreation facilities ate reconfiguring playgrounds to make them more accessible, including the use of resilient surfaces which can be traversed by wheelchairs. [Pg.20]

The quality of life experienced by people with MCS is shaped, to a great extent, by the level of awareness of environmental health issues where they live and work. Some are recipients of workplace accommodations in accordance with the Americans with Disabilities Act others are harassed and ostracized at work, or fired from their jobs. Some disabled by chemical exposures in the workplace receive workers compensation the majority of chemical-illness claims are denied. Some cities, schools and other institutions have adopted fragrance-free policies and Integrated Pest Management (IPM) programs to reduce chemical barriers and dangers in public places others still resist despite all the prevalence studies and research indicating that MCS is a serious threat to public health. [Pg.11]

On July 26,1990, President Bush signed the Americans with Disabilities Act (ADA) into law. One of the principal aims of the ADA is to extend the civU rights protection provided to groups based on race, color, national origin, sex, and religion to the more than 43 million American citizens with disabilities. The protection provided in the ADA aims to increase the wage rate and the employment rate of disabled individuals by eliminating employer discrimination. [Pg.132]

Before passage of the Americans With Disabilities Act (ADA), many fire departments conducted a medical examination early in the process, before the physical ability test. Now, the ADA says it is illegal to do any examinations or ask any questions that could reveal an applicant s disability until after a conditional offer of employment has been made. That means that in most jurisdictions you will get such a conditional offer before you are asked to submit to a medical exam. [Pg.35]

Hernandez sued the company, claiming that the Americans with Disabilities Act (ADA) did not allow discrimination against rehabilitated alcohol or substance abusers. The district court dismissed the suit, but it was then appealed to the Ninth Circuit Court of Appeals. [Pg.76]

Americans with Disabilities Act of 1990 (ADA). The ADA prohibits employer discrimination against qualified individuals who are labeled as disabled. It requires employers to make reasonable accommodations for disabled employees to permit access to their jobs. [Pg.151]

In addition to sexual harassment and accommodation of religious beliefs, equal treatment for individuals with disabilities is a significant issue for the treatment of both employees and customers. The Americans with Disabilities Act provides equal opportunity for persons who are disabled in the workplace. This act prohibits discrimination in all aspects of employment from hiring to firing, similar to practices that are covered by equal opportunity employment laws. Persons are considered disabled if they have either a physical or mental impairment that significantly limits one or more major life activities or have a record of impairment. Also, discrimination against a person who has a relationship with a disabled person is prohibited. [Pg.205]

The Americans with Disabilities Act (ADA) of 1990 has affected almost all businesses, including pharmacies. This federal mandate prohibits discrimination based on any form of disability. To comply with the ADA, pharmacies may be required to adjust counter heights, aisle widths, telephone equipment, doorways, and almost any other physical aspect of their operations. The act allows for reasonableness in designing stores without undue hardship on daily operations. The design goal is to have a store that offers equal access to all products and services for all customers (Laskoski, 1992). [Pg.405]

Write job-related and nondiscriminatory questions Avoid any questions that are not directly related to the essential functions of the position or that may be construed as discriminatory In general, it is inappropriate to ask questions about an individual s race, color, religion, sex, or national or ethnic origin (Title VII of the Civil Rights Act of 1964), their age (Age Discrimination in Employment Act of 1967), or disability status (Rehabilitation Act of 1973 and the Americans with Disabilities Act of 1990), as well as their marital status, sexual orientation, or parenting responsibilities. [Pg.73]

Since the adoption of the FLSA in 1938, there have been few modifications to the original act and regulations. Other pieces of federal legislation have been passed to safeguard against discrimination in employment and pay practices, such as the Equal Pay Act of 1963 (amended in 1972), the Civil Rights Acts of 1964 and 1991, and the Americans with Disabilities Act. [Pg.91]

Slip resistance is quantitatively characterized by the static coefficient of friction. It is also—informally-called traction. A sufficient slip resistance is important with respect to human locomotion safety. It is of a particular concern for elderly people, as prescribed in Americans with Disabilities Act (ADA), which set a quantitative limit to the static coefficient of friction, now retracted (see below). [Pg.369]

Floor or deck surfaces, to be considered slip-resistant, should have a static coefficient of friction of 0.5 or greater. This was also a code requirement of ADA (Americans with Disability Act). [Pg.371]

In 1990, the Americans with Disabilities Act made recommendations for the static coefficient of friction to be not less than 0.5. These recommendations have since been removed. ADA has retracted the recommendations because there were numerous ways to measure the coefficient of friction for different materials, and no single test device or procedure has been identifled in the ADA recommendations. [Pg.371]
