Named Person

A named person should be made responsible for carrying out each agreed recommendation, and a completion date agreed with him or her. The report should be brought forward at this time otherwise, nothing will happen except a repeat of the accident. 

Because privacy of the home is the essence, the Fourth Amendment, poHce actions must relate to the authorized intrusion. AH searches outside the judicial process, without prior approval of a judge, is per se unreasonable [24]. The poHce must estabHsh exigent circumstances to overcome this presumption. Only poHce can serve a warrant. Furthermore, members of the media and third parties cannot be present during execution of a search warrant [25, 26]. It is noteworthy that a vaHd arrest warrant cannot be used to enter the home of a third party named in the warrant. This guideline lays down the roles and responsibilities of the MAH and of the national competent authorities in respect of the products authorised through the national procedures (including the mutual recognition procedure). Better assessments identify named persons and target dates for implementing findings as part of the action plan. An example of a form to record a task-based risk assessment is provided at Appendix 5.1. 

Having recorded the recommendations and assigned a priority rating, ideally the action plan should enable a specific named person, or a key role, e.g. human resources manager for training requirements, within an organisation to be nominated to take responsibility for implementing the recommendations contained within the action plan.

The fields Named Person (NA) and Company Name (CO) allow one to target individual company names or people. As the names may be written differently, it is again advisable to select the search term from a list generated through an EXPAND command. 

If there are multiple victims, it is essential that clothing and other material are not mixed up but kept scrupulously separate.
