The pilot-in-cominand shall be responsible for the operation and safety of the aeroplane and for the safety of all persons on board, during flight time.  [Pg.93]

The legal responsibility placed on the commander of the aircraft is therefore inextricably linked with the expectation of good airmanship. Airmanship has been [Pg.93]

Parshall (1989) notes that product liability issues are complex and varied. An attorney knowledgeable in product liability issues may be an important contributor to process hazards discussions if such issues may affect the advisability of a proposed process chemistry. [Pg.60]

The life cycle cost of a process is the net total of all expenses incurred over the entire lifetime of a process. The choice of process chemistry can dramatically affect this life cycle cost. A quantitative life cycle cost cannot be estimated with sufficient accuracy to be of practical value. There is benefit, however, in making a qualitative estimate of the life cycle costs of competing chemistries. Implicit in any estimate of life cycle cost is the estimate of risk. One alternative may seem more attractive than another until the risks associated with product liability issues, environmental concerns, and process hazards are given due consideration. Value of life concepts and cost-benefit analyses (CCPS, 1995a, pp. 23-27 and Chapter 8) are useful in predicting and comparing the life cycle costs of alternatives. [Pg.65]

Continuous conductivity measurement controlled with the electrode placed in the boiler. This method is not recommended because of potential safety and liability issues. In addition, there are difficulties with cleaning and maintaining the electrode, and the intense heat to which the electrode is constantly subjected may cause failure. FT boiler installations generally provide for the electrode to be placed above the first set of tubes but 4 to 6 inches below the waterline. [Pg.77]

Vaccine liability issues were also covered in Section 304 of the Homeland Security Act (HSA) of 2002as amended in April 2003, in which Congress enacted liability protection for manufacturers of smallpox vaccines. Vaccine liability can be handled in four different ways the government can substitute itself as the defendant, it can decide nobody need be liable and provide no-fault compensation, it can indemnify manufacturers after they have been sued and lost, or it can alter the normal rules of litigation. In the HSA, the government substitutes itself as the defendant if the HHS Secretary declares an actual or potential bioterrorist incident or other actual or potential public health emergency makes advisable the administration of a covered countermeasure," such as a vaccine. Secretary Tommy Thompson issued the first such declaration on January 24, 2003. [Pg.496]

Some companies are already using substitution as a means of eliminating hazardous chemicals from their businesses, (see Annex I) A variety of reasons exist for why some companies are searching for safer substitutes and these include regulatory drivers (such as the recent Directive on the Restriction of Hazardous Substances), increased public awareness, demands from downstream users or clients, worker protection, liability issues, competitive advantage and company ethics. However, there are also barriers and the development and adoption of safer substitutes is happening only slowly, in a piecemeal fashion and in some sectors not at all. [Pg.3]

As discussed earlier, forensic pharmacology and toxicology are not limited to the study of drugs of abuse or poisons. These fields of science also have a growing role in the legal system to help resolve civil issues related to chemical exposure and cancer causation, medical malpractice as a result of drug interactions, and product liability issues. [Pg.122]

By October, 1980, Superfund had bogged down in the Senate over the extent of clean-up issues and liability issues. The White House attempted to get the legislation moving again by holding a series of meetings at the White House involving EPA, the Justice Department, industry representatives and some of the Senate Staff. Extent of clean-up was a major subject of these discussions. [Pg.2]

In contrast to the above described i.v. administration more important is to perform an i.a. tolerance. This is because cases where i.v. drugs have been erroneously administered by i.a. administration have increased during recent years, and liability issues have become a problem if such testing is not performed (Stotzer 1989). [Pg.798]
