Legal mandate

Sometimes you can use your legally mandated course of action to leverage a voluntary admission on the part of a client. If you remind the client that you are now bound to report the incident if she or he is not willing to seek help, then frequently the client will acquiesce and voluntarily seek help. Your responsibility is to make certain that the client actually follows through rather than simply feigning compliance. Obviously this outcome is preferred, since it helps to preserve the therapeutic alliance, whereas an involuntary commitment often harms your relationship with a client. 

Some clients are sent to treatment or therapy, and to aftercare, under legal mandates by the courts. Other clients may be sent to treatment or therapy, and to aftercare, by employers or even by school officials. These clients often are referred to as mandated clients. Mandated clients generally have special needs that other clients may not have. 

All international, national and local laws or regulations are to be complied with, in both prescriptive requirements and underlying objectives. Laws are provided to achieve the minimum safeguards that are required by a society to exist without excessive turmoil. Industry must abide by these laws in order to have a cohesive operation without fear of legal mandates. 

Third, whenever possible, this communication needs to be interactive. In the registration of pesticides, legally mandated deadlines, the complexity of the assessment, the manifold assumptions needed to fully explore methods and their outputs, and the need to protect sensitive business information limits the degree to which stakeholders may always be able to participate interactively. Nevertheless, opportunities for meaningful interaction with stakeholders, especially those that can bring additional data or information to bear and can constructively review the process, will benefit practitioners.

Animal studies, or cancer bioassays, are used to identify carcinogens. As we have said, several hundred chemicals have been so identified, and many are under test at this very moment. Some chemicals are selected for testing because certain laws require that manufacturers do so. In many cases there may be no clear legal mandate that manufacturers conduct such tests, so that the task has been taken on by the federal government, largely by NTP, as noted earlier. 

The perfect research strategy in chnical trials involving human performance capacities to determine therapy effectiveness and safety may not be possible due to financial and/or ethical considerations. Thus the challenge of chnical trials research in the future is to maintain scientific integrity while conforming to legal mandates and staying within economic feasibility i.e., an optimization is almost always necessary. Multidisciplinary research efforts can be useful in these circumstances. 

It is potentially criminal to deny the inspector entry. Section 16 criminalizes violations of 15, and 15 prohibits refusing to permit an inspection. Even without the threat of criminal prosecution, a responsible corporate citizen should cooperate with any legally mandated inspection.
