If there is a Iiigh level of citizen involvement or there is significant media attention, the resulting penalty for any of the above violations will nonnally become exacerbated. In addition, Wilcox and Tlieodore Iiave provided information on probable criminal prosecution for unetlrical conduct. [Pg.71]

I wondered what Pauley would say. "It s bad poker," he had once remarked to me in Tokyo, "to assume that all these Communists in Europe and Asia are being made by Joe Stalin or Karl Marx." But Pauley thought my interest in Farben was unusually intense often he had referred to me as "I.G. Joe." I wondered whether he, as a businessman, might not shy away from the idea of criminally prosecuting foreign businessmen with close connections in this country. [Pg.17]

A comprehensive approach to a states response to a chemical terrorism includes having a plan not only for the crisis and consequence management phases of the incident, but also for all elements required for complete resolution of the event. This may include the necessity to definitively establish whether chemical agents were used, to provide supporting evidence to confirm other analyses, or to provide the forensic proof required to support a criminal prosecution. The collection and analysis of biomedical samples - blood, urine or other tissue from affected humans or animals - is one of the means for providing such information. Although current capabilities such as urinary thiodyglycol excretion or plasma cholinesterase activity can be performed, there is scope for far more sensitive and specific assessments that overcome the limitations of these approaches. [Pg.123]

Social and economic harms Some invasions of privacy or breaches of confidentiality could result in embarrassment with one s business or social group, loss of employment, or criminal prosecution. Confidential safeguards must be strong in these instances. Examples of these particular sensitivities include information about alcohol or drug abuse, mental illness, illegal activities, and sexual behavior. Participation in research may also result in additional costs to the participant. [Pg.433]

Introduction Criminal prosecutions of violations of the FDCA are intended to further the goal of protecting the health and safety of the public. The FDA historically has not pursued criminal charges unless the defendant shows a continuous or repetitive course of violative conduct, with the exception of intentional violations, fraud, or danger to health.18... [Pg.61]

Penalties associated with the TSCA can be very steep. Civil penalties of up to 25,000 per day can be issued, and criminal prosecution may also be pursued. The greater the damage to the environment, the greater the fines, which increase accordingly. The TSCA Civil Penalty Policy has been created to determine appropriate penalties for each violation. Proposed penalties have been as high as 17 million. [Pg.29]

This fear of prescribing opioids even when the patient is obviously suffering has been labeled opiophobia. They face potential criminal prosecution if these records do not conform to federal law. Many physicians are also wary of getting their patients hooked on these narcotics. [Pg.252]

If the conviction should nevertheless become prevalent that the eyewitnesses erred in their corresponding testimonies, then an expert can only confirm that there is no longer any basis upon which to draw up an expert opinion, and, in the opinion of this author, there will no longer be any basis upon which court judgments, a method of historiography established by criminal law, or criminal prosecution of certain statements could be based. [Pg.291]

After I had sent out my first research results in spring 1991 to this list, I was contacted by one person on that list, a friend of ret. Major General Otto Ernst Remer, a retired Wehrmacht officer. At that time, Remer was engaged in publishing political pamphlets, some of which made quite blunt revisionist statements, which had led to several criminal prosecutions against him. Because of this, his friend and the Diisseldorf lawyer Hajo Herrmann, a well-known former Luftwaffe fighter pilot who was now Remer s defense attorney, were looking for an expert to support Remer s revisionist claims. [Pg.313]

The criminal prosecution of persons of whom it can be proven that they deliberately composed and distributed false information is problematic, since the proof of the assertion that a journalist deliberately spread false news—that he lied—could only rarely succeed. The simple assertion that the journalist must have known that his report was not true since all others knew it should never suffice.641... [Pg.403]

Webster s Dictionary defines a standard as something established by authority, custom, or general consent as a model or example and states that standard applies to any definite rule, principle, or measure established by authority (standards of behavior) (Webster s, 2003). From a contemporary managerial perspective, standards of conduct for a pharmacist and for the operation of a pharmacy are derived both from laws and from professional standards or values. Standards for professional conduct and the operation of a pharmacy, whether stated formally in statutes and regulations or present in professional codes of ethics, are important for managers to understand and apply. Violations of these standards can affect the licensure status of a pharmacy practice site and/or its pharmacists, may result in litigation if a patient is harmed subsequent to a violation, and in the most serious cases can result in criminal prosecution. Both criminal prosecution and civil liability resulted in the case of Robert Courtney, the pharmacist discussed in the scenario. Courtney was sentenced to 30 years in prison, fined 25,000, and ordered to pay 10.4 million in restitution to the patients and families affected. These penalties were in addition to the civil judgment of 2.2 billion (Stafford, 2002). [Pg.505]

One might expect that the truth will hold its own in a factual, scientific encounter even without the protection of criminal law. On the other hand, it is almost impossible for truth to prevail under the constant threat of criminal prosecution. [Pg.51]

All in all, the Central Office seems to regard itself more as an institute for historical research operating with unconventional methods than as an office for criminal prosecution Riickerl, in any case, considers its findings historical facts.166 Steinbach even suggests that in the future, after the end of the NSG trials, the Central Office ought to be turned into an institute for historical research,167 which apparently is the plan of German politicians, too.168... [Pg.105]

It is further food for thought that defense attorneys in NSG trials are exposed to public attacks which at times go as far as physical assault and professional disciplinary hearings or even criminal prosecution, should they ask for or try to present evidence that challenges the self-evidentness of the Holocaust111... [Pg.110]
