Mandated clients

Some clients are sent to treatment or therapy, and to aftercare, under legal mandates by the courts. Other clients may be sent to treatment or therapy, and to aftercare, by employers or even by school officials. These clients often are referred to as mandated clients. Mandated clients generally have special needs that other clients may not have.

Whether or not a toller site or a specific ongoing toll process is covered under a regulatory mandate to manage changes, there is always a question of when to involve the client in day-to-day management of change (MOC) activities. 

Finally, another obstacle is that some clients will not seek help out of fear that others will discover that they have drug problems and use that information against them. One solution is to educate the client about federal confidentiality laws that protect against disclosure while in treatment, or state laws that protect client confidentiality in therapy. Flowever, you also should be very honest that there are ways in which confidentiality can be suspended, or when outside institutions can access personal health information. For example, make sure to explain that state confidentiality laws can and will be suspended if the client expresses thoughts about harming him- or herself or others, and in some states, if he or she damages property. Additionally, if a client is mandated to services, he or she should be told that those officials who mandated the treatment may have access to treatment records and reports. Finally, tell clients that insurance carriers and their representatives also may have the right to access that information. Clients should be made aware that there are a number of protections in place to protect them, but also told frankly that some of the protections have limits. 

Sometimes you can use your legally mandated course of action to leverage a voluntary admission on the part of a client. If you remind the client that you are now bound to report the incident if she or he is not willing to seek help, then frequently the client will acquiesce and voluntarily seek help. Your responsibility is to make certain that the client actually follows through rather than simply feigning compliance. Obviously this outcome is preferred, since it helps to preserve the therapeutic alliance, whereas an involuntary commitment often harms your relationship with a client. 

Sweaters or sports jackets are not required, but may still be considered appropriate for certain situations, such as meetings with clients. Management retains the option to mandate such in certain circumstances. 

Selection and validation of testing methods are key issues in paternity testing. Specific requirements for paternity testing may be mandated by local laws and agreements. Thus the choice of methods and genetic systems should be based on an agreement between the client(s) and the laboratory.

Based on the information in the previous section, treatment would not be expected to have much of an impact on substance use and the problems related to addiction. Surprisingly, that is not the case.
