Bubble Policy The bubble concept introduced under PSD provisions of the Clean Air Act Amendments of 1977 was formally proposed as EPA policy on Jan. 18, 1979, the final policy statement being issued on Dec. 11, 1979. The bubble pohcy allows a company to find the most efficient way to control a plant s emissions as a whole rather than by meeting individual point-source requirements. If it is found less expensive to tighten control of a pollutant at one point and relax controls at another, this woiild be possible as long as the total pollution from the plant woiild not exceed the sum of the current hmits on individual point sources of pollution in the plant. Properly apphed, this approach would promote greater economic efficiency and increased technological innovation. 

Although the EPAs policy does not consider recycling or treatment as actual pollution prevention methods per se, these methods present an opportunity to reduce the amount of waste that might otheiwise be discharged into the environment. Clearly, the definition of pollution prevention and its synonyms (e.g., waste minimization) must be understood to fully appreciate and apply these techniques. 

Once hazardous wastes are transported from a CERCLA site, they are subject to full RCRA regulation. Therefore, all transportation and TSD requirements under RCRA must be followed. This means that off-site shipments must be accompanied by a manifest. In particular, the off-site disposal of hazardous wastes can occur only at an RCRA facility in a unit in full compliance with the requirements. U.S. EPA policy requires that the disposal facility be inspected six months prior to receiving the waste. 

We conclude that discovery of reduced risk pesticides has significantly facilitated the transition by many farmers away from high-risk pesticides. This transition has clearly helped reduce risks in some key children s foods. EPA policies put in place to expedite registration of reduced risk products should be strengthened. 

EPA policy concerning relaxed enforcement of prohibitions on storage of mixed waste does not extend to Executive Branch federal facilities, including DOE facilities. The Pest Management Regulatory Agency (PMRA) of Fiealth Canada proposed to harmonize with the US EPA policy on common mechanism of toxicity. PMRA issued guidance for identifying pesticides that have a common mechanism of toxicity that was adapted from the US EPA guidance document.

While generally, a mixture is considered a hazardous waste if it contains a listed waste or if it exhibits a hazardous characteristic, a September 1997 EPA policy letter stated that a mixture is exempt if it contains exempt oil and gas E P waste mixed with non-hazardous, non-exempt waste. EPA says you should avoid mixing wastes as much as possible, and especially exempt and non-exempt wastes. In addition, mixing exempt E P waste with nonexempt characteristic hazardous waste for the purpose of rendering the mixture non-hazardous or less hazardous could be considered hazardous waste treatment or even dilution — which is not permitted under RCRA. 

There are certain types or forms of hazardous substances that are not reportable under CERCLA or EPCRA, even though they otherwise meet the hazardous substance listing criteria, as a result of EPA policy determinations. These types of hazardous substances are not reportable because EPA has determined that a release of these substances either does not present a substantial endangerment to human health or the environment or would impose an unnecessary burden on the NRC, SERCs, LEPCs, and regulated community. The types or forms of hazardous substances that are not reportable to the NRC, SERCs, or LEPCs are listed below.

Title III of the CAAA added a new section (112(b)(6)) that excludes these HAPs listed in Section 112(b)(1) of the revised act from federal PSD requirements. Current EPA policy (New Source Review Program Transitional Guidance, March 11, 1991) clarifies that states with approved PSD programs may continue to regulate these pollutants under state PSD regulations.
