Personnel. More than any other area, we are often asked "How many people has your corporation added due to TSCA " I don t know of anyone who has a concise answer to this question. Historians tend to agree that Earth Day had a profound effect on the environmental consciousness of public officials and ordinary citizens. The 1970s saw the adoption of a series of environmental programs at both federal and state levels. Two major acts passed during this period were the Clean Air Act of 1970 and the Federal Water Pollution Act of 1972. 

Success in Solving Environmental Protection Problems. The EPA reported that 1303 chemical plants out of 1371 were in compliance with the 1970 Clean Air Act. This represents a 95 per cent compliance rate. Also, 89 per cent of the chemical plants were in compliance with the 1977 deadline of "best practicable control" specified in the 1972 Federal Water Quality Act Amendments. (4) Hence, the chemical industry has been somewhat successful in utilizing its technology to meet environmental protection standards. Water pollution due to discharge of toxic chemical wastes is closely regulated by both the EPA and FDA. Such substances are defined in the 1972 amendment of the Federal Water Pollution Control Act as those which will cause death, disease, cancer, or genetic malfunctions in any organisms with which they come into contact. Substances added to water for purification purposes (chlorine, aluminum sulfate, etc.) are excluded from the category of pollutants. In the environmental area, the compliance manuals tend to follow the architecture of the media-specific federal environmental laws a section or manual on the Clean Air Act of 1970, a section or manual on the Federal Water Pollution Act of 1972, a section or manual on TSCA, etc. However, business operations are neither law-specific nor media-specific. One business operation may involve compliance with many different legal requirements under different laws. To be an effective procedure, the procedure must ensure that the person who is expected to follow the laws is given the tools to meet the legal requirements. 

TSCA is not unique in having a whistleblower protection. At least seven other environmental statutes, including the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), the Solid Waste Disposal Act (SWDA), the Federal Water Pollution Control Act (FWPCA), the Energy Reorganization Act of 1974 (ERA) , the Safe Drinking Water Act (SDWA) and the Clean Air Act (CAA) ° have similar provisions. ...

Despite its low profile in the EPA, TSCA fines collected for violation of this complex scheme of chemical regulation have often exceeded those collected under the Resource Conservation and Recovery Act, the Comprehensive Environmental Response, Compensation and Liability Act, the Clean Air Act and the Federal Water Pollution Control Act. Much of this enforcement is centered on the information collection and reporting requirements of TSCA.
