Consensus standards are the key to the voluntary standards system because acceptance and use of such standards foUow direcdy from the need for them and from the involvement in their development of all those who share that need. Consensus standards must be produced by a body selected, organized, and conducted in accordance with due process procedures. AH parties or stakeholders are iavolved in the development of the standard and substantial agreement is reached according to the judgment of a properly constituted review board. The court declared that the commerce clause of the Constitution (allowing Congress to regulate interstate commerce) did apply to Puerto Rico as a U.S. territory. Nor do we consider the underlying constitutional issues today. Because the Court of Appeals did not address these claims, we decline to do so in the first instance.

The draft standard is next reviewed by the parent subcommittee, and at this stage balloting becomes formal. Balloting is necessary to ensure that the standard has the proper review of due process so that it rests on a sound procedural foundation. The review at this stage usually is mostly technical. 

The DUE process allows the health care organization to use the results of the evaluations to compare the quality of care delivered by practitioners. This peer evaluation is often used by managed care organizations to encourage physician compliance to use formulary drugs, generic substitution, and clinical prachce guidelines. 

The responsibility for assuring appropriate drug use rests with all professionals in fhe medication use process, but pharmacists have the opportunity to take the lead in continually improving this process. The DUE process has evolved into a core funchon for pharmacists and will continue to evolve as more sophisticated tools of idenhfying and resolving medication-related problems are developed. 

The MRC is convened when required to consider objections to recommendations made under section 22 (2) of the Act (i.e., in relation to applications for consent to distribute a medicine) and to hear appeals in regard to the issuing of licences and applications to carry out clinical trials. The MRC is not bound to follow any formal procedure in its deliberations, but generally confines its scope to consideration of whether due process weis observed in the assessment of the original applications. 

The first of these values is fairness. In the U.S. constitutional tradition, judges are steeped in the notion of due process.
