Many companies, in their internal training, include information about the anti-kickback statute. The Office of the Inspector General in the Department of Health and Human Services (HHS) enforces the antikickback law. HHS administers the Medicaid and Medicare programs. Any serious violations are referred for potential criminal prosecution to the Department of Justice administrative sanctions also are possible. [Pg.64]

This inspection process has recently been augmented with the establishment of an Office of the Inspector General (OIG) which reports at the level of the Secretary, not the FDA Commissioner. One of the first announced targets of the OIG, selected from the entire realm of foods and dmgs that FDA regulates, is clinical trials. In particular, the OIG is actively investigating informed consent documents, and also has notified institutional review boards (the US equivalent of the ethics committee) that they are in for close scmtiny. [Pg.402]

While enforcement authority for informed consents exists in the FDA and in other non-US national and regional health authorities, the enforcement agency responsible for HIPAA in the US is the Office of Civil Rights (OCR) within the Department of Health and Human Services (HHS). Event reporting Event reporting is important for hospitals to understand patient safety risks and enable them to take steps to prevent and mitigate harm to patients. However, the status of event reporting in the US still shows considerable nnderreporting.
