Consolidation rules

The statute requires a hearing under the Administrative Procedure Act if the company or person that the EPA proposes to penalize asks for one. The EPA must give fifteen days notice of the right to request a hearing before it issues a final order. The EPA has promulgated Consolidated Rules of Practice for civil penalty assessments that is a procedure manual for all civil TSCA penalty assessments. The Consolidated Rules of Practice governs hearings and appeals to the EPA s Environmental Appeals Board. [Pg.498]

Each EPA Region, as well as EPA Headquarters, can assess a penalty for a TSCA violation. The EPA will typically exercise considerable discretion in reducing negotiated penalties. The Consolidated Rules of Practice governs civil penalty assessments, and requires that each Region have a Regional Judicial Officer who is a lawyer and conducts hearings and may have authority to approve settlements. ... [Pg.508]

The Consolidated Rules of Procedme confirms that a penalty proceeding can be commenced and settled simultaneously. Many people take advantage of this option, as demonstrated by the consent agreements posted on the Environmental Appeals Board Web site that say that they were simultaneously commenced and concluded. ... [Pg.508]

The Consolidated Rules of Practice recites the elements that must be in a TSCA complaint. These include a reference to 16 s civil penalty authority, a reference to the statutory and regulatory provisions that were allegedly violated, the factual basis for the allegations, and the relief and monetary penalty sought. The complaint must provide notice of the respondent s right to a hearing, specify if the Administrative Procedure Act applies (which it does), and be accompanied by a copy of the Consolidated Rules of Practice. [Pg.513]

Certain factors must, however, be considered in choosing the appropriate analytical solution unconsolidated vs. consolidated conditions, fully vs. partially penetrating wells, variable discharge rules, delayed yield, and aquifer boundaries. Most methods are best suited for unconsolidated aquifers with well-defined overlying and underlying boundaries, whereas with consolidated aquifers, the effective aquifer thickness is uncertain. A pumping well that fully penetrates a confined aquifer (i.e.,... [Pg.69]

As a conclusion to his preparative course the student should undertake several preparations, for which he has to look up the appropriate methods in scientific journals, instead of finding them worked out in minute detail in a manual of laboratory instruction. In so doing he will learn, with the aid of the directions given above, how to consult the literature, and how to make use of the chemical library most of all, however, these more difficult preparations will serve to test his capacity for laboratory work. When synthesising a compound in several stages it is absolutely essential to test and consolidate each separate stage by means of test-tube experiments before the whole of the substance is risked. Whoever fails to observe this rule will pay dearly for his neglect by loss of material and time. [Pg.422]

Court action was instigated by the industry in the U.S. Court of Appeals for the Fourth Circuit( ). Meanwhile, AFL-CIO also entered suit against the Department of Labor in the Court of Appeals for the District of Columbia Circuit, claiming that the final rule was too lax( ). All court actions eventually were consolidated in one case in the D.C. Circuit Court of Appeals (10). [Pg.7]

Further to "consolidate and amend the law relating to narcotic drugs, to make stringent provisions for the control and regulation of operations relating to narcotic drugs psychotropic substances, and concerned matters", the "Narcotic Drugs Psychotropic Substances Act Rules was passed in September 1985. [Pg.23]

The BLA was established pursuant to the Food and Drug Administration Modernization Act of 1997, consolidating a prior requirement for two applications a Product License Application and an Establishment License Application. The final implementing rule reduced the amount of information a manufacturer is required to file in its BLA application and shifted responsibility to the plant inspection process to ensure that manufacturers complied with cGMP standards. [Pg.36]

In this chapter, we consolidate the nomenclature of a number of classes of compounds —an undertaking that may not seem very logical to someone who will soon be troubled enough with the chemistry of these compounds let alone their names. We recommend, however, a thorough study now of alkane and haloalkane nomenclature (Section 3-1) followed by a more cursory examination of the rest of the chapter. Then, as unfamiliar names arise, you can quickly review the basic rules for alkanes and proceed to the new class you have encountered. The idea is to have many of the important rules in one place. Nomenclature rules for other types of compounds are given in Chapter 7. [Pg.51]

The chemical industry is experiencing important changes, the driving force for which is not only the need to improve competitiveness and consolidate market positions while complying with regulations and rules for the protection of human health and of the environment, but also the increased awareness that in the near future all the raw materials and energy chain supply will have to be reconsidered. [Pg.289]

In a second phase, alternative sites to locate the consolidated site were evaluated. Four sites were considered with one of the alternatives involving a co-location at an existing site and the others requiring the construction of a new site. To reflect the nature of the decision problem the objective hierarchy described above was modified to include the net present value of the alternatives in addition to the qualitative criteria. On this basis trade-offs between qualitative and quantitative objectives were analyzed. In the case example it turned out that co-locating the plant at the existing site is both the most attractive option financially (mainly because no property rent or acquisition was required) and from a qualitative perspective (mainly due to proximity of the existing site to major customers). It should be noted that no major utilities infrastructure was required for the value chain considered and hence constructing a new site could not be ruled out up front for financial reasons. [Pg.160]

The question of why a seller would choose to dispose of such a product becomes an important one. In a consolidating market the most usual cause is the forced divestment of assets during a merger or acquisition where agencies such as the Federal Trade Commission or the anti-competitive activities arm of the European Commission must rule on the combination of portfolios between prospective partners to ensure that a monopolistic position or market dominance does not result from the merger or acquisition and so disadvantage the consumer. [Pg.101]

The R and S nomenclature was first presented in 1951 by Cahn and Ingold [26], and then consolidated and extended by Cahn, Ingold and Prelog [27,28]. The essential part of this nomenclature (also called the CIP nomenclature) of chiral centers is the sequence rule, i.e., a set of arbitrary but consistent rules which allow a hierarchical assignment of the substituents (a > b > c > d). [Pg.12]

In general, a material flows poorly if its strength is large relative to the consolidating stress o-j. Jenike called this ratio of o-i to, the flow fimetion (F = ai/f ). It is generally not constant because, as a rule, the compressive strength is not proportional to the principal stress 0-1. This ratio esm be used to make a classification of the flow according... [Pg.601]

The rate equation 6.12 was derived without use of any short-cuts. With rules to be shown in Section 7.3.1, algebra could have been reduced. Specifically, the steps following the irreversible formation of the cobalt acyl (X5) could have been omitted (Rule 7.12) and the pairs of steps from X, to X3 and from X3 to X5 been consolidated each into a single step (Rule 7.24). This would have reduced the mathematics of conversion of the x-complex to the aldehyde to that of a pathway with only two instead of six steps. [Pg.128]
