Compensation Act

In response to continued concerns about vaccine safety, the National Childhood Vaccine Injury (NCVI) Act of 1986 established a no-fault compensation process for people injured by them. The NCVI also mandated that the Institute of Medicine (lOM) reviews scientific evidence of vaccine-related ADRs in children. In 1996, the Department of Health and Human Services (HHS) made changes to the NCVI, which lessened its usefulness. In response to the problems this generated, the Vaccine Injured Children s Compensation Act of 2001 was introduced in Congress. This bill, however, also has its problems, and in April 2001, the bill was referred to the House subcommittee on health, where it still... [Pg.496]

An area of excellent cooperation between the federal and state partners is that of extended UI benefits. The Extended Unemployment Compensation Act of 1970 created a permanent programme for extended UI benefits when unemployment rates exceed certain preset trigger levels. [Pg.373]

It is this compensation culture that forms the third aspect of Brown and Hanlon s (2014 3) unholy alliance of official self-importance, media hysteria and commercial exploitation. The commercial opportunities for both consultants and lawyers are seemingly just too tempting to prise them away from safety, and the UK government s attempted intervention in the form of the Compensation Act of 2006 has actually done little to reduce the flow of cases. As a result safety has become enmeshed in a mire of litigation, companies drowning in the evidence of responsibility (not the responsibility itself) and the ongoing quest to shift liability - all of which are of course distractions from the actual business of keeping people safe at work. [Pg.30]

Individual state workers compensation act Whether the safety and health professional possesses a direct or indirect responsibility for workers compensation claims, it is imperative that an expert-level knowledge of the applicable workers compensation laws and regulations for each state in which employees are working be acquired and maintained. Additionally, safety and health professionals should possess a thorough knowledge of all aspects of the workers compensation administration and management. [Pg.105]

South Africa introduced new safety and health legislation in the form of the Occupational Health and Safety Act (Act 85 of 1993). This OHS Act replaced the Machinery and Occupational Safety (MOS) Act, and in 1994 the Compensation for Occupational Injuries and Diseases Act (Act C of 1994) replaced the Workmen s Compensation Act. [Pg.16]

Our numerical simulations and the econometric research we reviewed also make us conclude that workers compensation insurance encourages workplace safety. Because increased workplace injuries raise a firm s insurance premiums workers compensation acts as a tax on injuries. As with any tax employers can limit payments by reducing the activity taxed. If the cost of purchasing WC falls more than the cost of new safety equipment or safety education programs then the firm will pay more attention to workplace safety. WTien strongly experience rated workers compensation insurance leads firms to the cost-benefit calculations necessary for cost effective safety expenditures. [Pg.199]

The Federal Employment Compensation Act provides workers compensation for nonmilitary, federal employees. Many of its provisions remain typical of most workers compensation laws. Many times awards remain limited to disability or death sustained while in the performance of the employee s duties. The act covers medical expenses due to the disability and may require... [Pg.41]

To avoid these language problems, different terminology is now in place. For example, the Federal Employees Compensation Act states that injured employees will receive compensation for the disability or death of an employee resulting from personal injury sustained while in the performance of his duty. It defines injury to include a disease proximately caused by the employment. ... [Pg.55]

The administrative problem of evaluating each permanent partial disability has given way to the widespread practice of schedules. Schedules set in advance the value of each kind of disability. Units for disability are weeks of lost earnings. For example, under the Federal Employees Compensation Act, the schedule says complete loss of a thumb is worth 75 weeks. Compensation is the number of weeks multiplied by the normal weekly wage of the person prior to injury. Practices in using schedules vary by state and the value of a scheduled loss can be quite different in different states. [Pg.57]

Following the decision in Young v. Bristol Aeroplane Company Limited [1944] 2 All ER 293 it became established that a workman was precluded from pursuing a claim at common law even where he did not know of his right to elect if he had in fact accepted weekly payments under the Workmen s Compensation scheme. The Workmen s Compensation insurance policies issued at that time indemnified the insured against his liability to pay compensation under the Workmen s Compensation Act, the Employer s Liability Act 1880 and the Factories Act 1846 or at common law in the event of personal injury to any employee arising out of and in the course of his employment. [Pg.112]
