Advice provision

It is very important to understand that an insurance policy is a legal document, and insurance negotiations should be approached on this basis. Insurance contracts have a detailed legal background of both case law and common law in the interpretation of their provisions. Professional insurance advice from a reputable source, whether an insurance company or an insurance broker, is essential if problems are to be avoided.

This working party considers the aspects of the manufacture and control of biotechnological and biological medicinal products and is also involved in the provision of scientific advice. Workshops on the applieation of assays for markers of transmissible spongiform encephalopathies (TSE) and on the potential risk of transmitting new variant Creutzfeld-Jakob disease (nv-CJD) through plasma-derived medicinal products have recently been held. 

These facts lead to obvious nutritional advice for the elderly vitamin and mineral supplements, increased intake of fruit and vegetables and provision of appetising food in an attempt to overcome reduced appetite. 

Complaints about pharmaceutical advertising made under the ABPl Code of Practice are taken up by the PMCPA. The PMCPA was established by the ABPl as from 1 January 1993 to administer the ABPl Code of Practice and consists of a director, secretary and deputy secretary. The authority is responsible for the provision of advice, guidance, conciliation and training on the Code of Practice, as well as for the operation of the complaints procedure. It is also responsible for scrutinising journal advertising on a regular basis. 

Giving advice with respect to safety, quality and efficacy, in relation to human use, of any substance or article (not being an instrument, apparatus or appliance) to which any provision of the Act is applicable. 

In order to encourage pharmaceutical companies to invest in orphan drug development, legislation provides for a number of incentives. These include application fee waiver (the extent of reduction varies with the region of the world, and in the European Union it is 50% for all fees since 2002), market exclusivity and protocol assistance. In the European Union, there is 100% reduction in the fee applicable to the provision of any scientific advice. The fund made available by the Community for fee exemptions for orphan medicinal products amounts to= 3 700000 in 2005. 

The Code is administered by the Prescription Medicines Code of Practice Authority which is responsible for the provision of advice, guidance and training on the Code as well as for the complaints procedure. Complaints which are made under the Code about promotional material or the promotional activities of companies are considered by the Code of Practice Panel and, where required, by the Code of Practice Appeal Board. Reports on completed cases are published quarterly by the Authority in its Code of Practice Review which is available on request. 

Disputes shall be settled in accordance with the General Agreement on Trade and Tariffs (GATT) provisions. A WTO panel shall seek advice on scientific or technical issues from experts chosen by the panel and the parties involved in the dispute. It is important to note that the Codex Alimentarius texts are the basis for decisions taken in such connections. When a country introduces regulations that are more detailed, or stricter, than similar Codex provision, that country should be prepared to defend the measures taken on scientific grounds in front of a WTO panel. 

Procedurally the R D Manager will have to decide, after consulting the relevant staff, what analytical support will be required for each project in the portfolio for the coming period. Following discussions with the analytical services manager, the cost and availability of in house provision can be determined. Analytical services should be able to provide advice on where to get the most economical external provision of non-available analytical support.

States Parties are required to designate or establish a National Authority to ensure the effective implementation of the CWC. The National Authority makes the initial and subsequent annual declaration on chemical weapon stocks or facilities, coordinates and participates in the receipt of OPCW inspections of industrial and military sites, participates in assisting and protecting member states under threat or actual chemical attack, and promotes the peaceful use of chemicals. The National Authority is thus the focal point in a country s interaction with other countries and the OPCW. The Technical Secretariat of the OPCW helps in the provision of advice, assistance and capacity development of relevant skills and expertise in the staff of national authorities. The secretariat also hosts and coordinates regular meetings of the national authorities from all over the world.
