Civil liberties and privacy advocates, however, oppose workplace drug testing as an invasion of privacy. Critics argue that few companies have conducted cost-benefit analyses that might demonstrate bottom-line benefits to having testing programs. 

State laws regulating workplace drug testing vary. Some states ban or limit the use of random tests without individual suspicion. Some states also provide for some form of appeals process or retesting for employees found to test positive.

BAC levels are also necessary for death investigations, since fatal accidents may involve alcohol as a contributing factor.
