In contrast to the situation for food and drugs, FDA has no specific regulations for plastic packaging materials or their additives for use in cosmetic packaging. Such packaging regulations as there are for cosmetics deal with issues such as labeling and tamper evidence, which are outside the scope of this book.

One serious discrepancy exists between requirements in this Pharmacopeia and ICH guidelines beyond the relative mandatory status. USP-NF requirements are enforceable by U.S. federal and state laws and regulations. The standards give the attributes of acceptable articles already used in healthcare. A key contrast can be seen in the strict focus of the ICH, which is explicit in treating new drugs, that is, those not yet in use. The situations differ dramatically in practical consequences and breadth of application. In addition to laws, criteria and systems discussed above, compliance with several standards play an important role in maintaining drinking water quality. These standards provide for development of criteria when none are available from the regulating body. For example, compliance with National Sanitation Foundation International/American National Standards Institute (NSF/ANSI) Standard 61, which addresses the potential for constituents to leach from components of drinking water systems into water moving toward the tap, is required under many state laws and regulations. 

The exact functions and responsibilities of pharmacy technicians are defined by state laws and regulations and are also determined by the willingness of pharmacists to delegate the nonjudgmental activities of their practice. It is the company s responsibility to provide testing for the driver that is in compliance with all federal and state laws and regulations, and within the provisions of this pohcy. The company will retain all records related to testing and the testing process in a secure and confidential matter. 

There are many factors that affect the choices available. One factor is laws and regulations. Federal and state laws and regulations specify acceptable methods for different hazardous materials. Some methods are not technically feasible or practical for particular materials.

There are currently 15 key federal laws related to the control and regulation of hazardous and toxic materials. A summary of these laws, their regulatory objectives, and primary responsible federal agencies is shown in Table 3.1. In addition there are many more state laws and regulations, often with more stringent requirements than their federal counterparts. It is important to review these state and federal regulations as part of the risk assessment process. The various laws and regulations provide specific definitions, specific lists of toxic and hazardous materials, requirements for compliance, and methods and standards for compliance.
