The Executive Branch sought to change warrandess searches and surveillance restrictions of the Fourth Amendment through congressional passage of the Patriot Act. The Act has engendered significant debate over the historic role of civil liberties and comparative abuse of power by previous administrations. 

Lawsuits were filed by various parties including the American Civil Liberties Union challenging the President s authority to conduct domestic surveillance. The Federal Court for Eastern District of Michigan found surveillance by the National Security Agency to be unconstitutional [175]. 

The Patriot Act, to some Americans is a threat to democracy and civil liberties to other Americans, it provides a promise of protection against endangerment of their society. Both opinions are justifiable. The Patriot Act and its progeny are well intended. However, based upon legal traditions, it is philosophically, constitutionally and practically contrary to America s foundational constitutional rights and dvil Hberties. The Patriot Act, especially concerning the Fourth Amendment, should be periodically revisited by Congress to coincide with basic civil liberties and tenets of constitutional law. 

I am taking a Phillip Zimmerman approach. Our rights are in the line of fire from both government and private entities, and everyone needs to have free access to this information. I want it to become widespread before adversaries have a chance to stop it. Any social problem as pervasive, serious, and contentious as drug abuse is bound to have a number of impacts on public policy, including civil liberties, public health, the workplace, and other areas. 

The effort to stop drug abuse and trafficking raises a number of important general civil liberties issues, including whether persons are being stopped without probable cause that they have committed a crime, whether racial or ethnic profiles are being used instead of specific evidence involving a particular individual, and whether the use of intrusive search techniques (such as use of aircraft or heat detectors) violates privacy.
