Private property rights

Many economists have therefore become disappointed in the effectiveness of traditional regulatory solutions to environmental problems. They look to market incentives such as those provided by private property rights, and market-like mechanism, where polluters must brd for or trade for the right to release potentially harmful emissions, as policy alternatives. [Pg.474]

The differences in the forms of resistance in the United States, Europe, and Canada is notable. Where institutionally and ideologically, the Canadian and European states are more corporatist than that of the United States, culture and law in the United States tends to favor private property rights more directly. It is unsurprising then to see greater regulatory activity in Canada and Europe. [Pg.126]

We are all staunch defenders of private property rights, yes We may not agree with what the other guy does with his property, but we have to respect the owner s rights. This was America, after all. Everyone agreed. [Pg.210]

Votteler, T.H. 1998. The little fish that roared the Endangered Species Act, state groundwater law, and private property rights collide in the Texas Edwards Aquifer. Environmental Law 28(4) 845-904. [Pg.18]

The liberal state is a recurring term in this project. The short explanation is that a liberal state is a state with some form of representative democracy, a market economy based on private property rights and constitutional protections of civil and political rights. Other attributes have been added There is a dense network of transnational transactions by social and economic actors, multiple channels of communication on all levels exist and the distinction between domestic and foreign issues is blurred. ... [Pg.21]

Part 1 introduces the subject matter. In Chaps. 1 and 2, the framework and outer limits of the project are provided. A very basic assumption is that international law is relevant. Another basic viewpoint is that international relations are based on much more than only binding international law. Regimes and institutions defined in broad terms are relevant. The project is limited to Europe while the term Europe calls for a clearer definition. The project deals with liberal states which are defined in terms of democracy, market economy, private property rights and civil and political rights. [Pg.282]

With strong incentives for businesses and other special interest groups, and weak incentives for individual voters, it is not surprising that many environmental regulations have often been less successful at preventing harm than the more traditional property rights-based approaches. Thus, while privately owned lands and resources are generally healthy and well preserved, many resources that are not owned, such as air or many waterways, are polluted. [Pg.474]

The expected private benefit depends on a number of market characteristics and public policies, including market size, intellectual property rights, price regulation, and the magnitude of prizes for innovation. Some public policies, such as the Orphan Drug Act, may affect both the costs and the expected private benefits of R D investment. [Pg.139]

For collective exposures, government should create ambient quality standards to achieve the same cost-versus-health balance observed in private market decisions. The government should then auction emissions property rights to the highest bidders and distribute the proceeds to all citizens equally. [Pg.3]

Quimby. You can cut her off at the knees, one man exclaimed. The two senators—Paul Davis and Steve Stanley—were uncomfortable at the suggestion, given Mainers usual emphasis on the rights of private property owners not named Roxanne Quimby. But neither of them would rule out the idea. [Pg.206]

Hitler recognized that the direct takeover of private property provokes powerful emotional and political resistance. One of the secrets of his rise to power was that he managed to portray the National Socialist movement as opposed to such a measure, indeed to Communism itself As Robert Proctor notes. Hitler understood that there was no need to nationalize industry when you can nationalize the people. 1 want to emphasize here that 1 regard right-wing Nazism and left-wing Communism not as two antagonistic political systems, but as two similar types of socialism (statism)—one brown, or national, the other red, or international. Both kinds of statists were very successful in their efforts to undermine autonomy and destroy morality. [Pg.145]
