Schedule Rates In the earlier days of workers compensation, employers could receive a percentage reduction in the premium rates by engaging in certain hazard reduction activities. Those activities will appear in a schedule. This technique is no longer used. A major reason is the difficulty and expense in monitoring compliance.

Sleep deprivation and sleep disorders question the scope of the definition of injury and work function in workers compensation cases. Generally, unless a clear link can be shown between the sleep disorder or deprivation and the scope of employment, courts are unwilling to grant compensation to the worker. Courts have regarded sleep and work as separate and distinct.

OSHAhas estimated a safe maximum noise level of 85 dB. The time-weighted average (TWA) is an exposure for an 8-h to a noise level not exceeding 90 dB. If this level exceeds 85 dB, OSHA requires the employer to institute a hearing conservation program (HCP). Therefore, if a company wants to avoid loss claims under worker compensation laws, it must not only meet the prescribed legal standards, but also attempt to reduce noise to the lowest possible level (< 80 dB). 

In 1968, 9.3 percent of the American labor force was on the medical dole ten years later, the figure was 14.7 percent. The cost to employers of Workers Compensation grew from 2.1 billion in 1960, to 57.3 billion in 1993, an increase of almost 3,000 percent. ... 

Although workers compensation is in theory a straightforward no-fault insurance system, in practice it is often arcane and adversarial. It is important to remember that the person being treated is the patient, not the employer or a referring attorney. 

As reviewed by Karwowski and Marras (1997), work-related musculoskeletal disorders currently account for one-third of aU occupational injuries and illnesses reported to the Bureau of Labor Statistics (BLS) by employers every year. These disorders thus constitute the largest job-related injury and illness problem in the United States today. According to OSHA (1999), in 1997 employers reported a total of 626,000 lost workday disorders to the BLS, and these disorders accounted for 1 of every 3 spent for workers compensation in that year. Employers pay more than 15-20 billion in workers compensation costs for these disorders every year, and other expenses associated with MSDs may increase this total to 45-54 billion a year. 

Workers compensation is Just such a system. It provides mandatory no-fault disability and death coverage for injuries and, to a lesser extent, illnesses arising on the job, financed entirely by employer contributions. To the extent that it is experience-rated, each employer s payment into the system is equal to the anticipated claims of his or her workers (tt c). All of the provisions of workers compensation are well-known in particular, workers can know with a high degree of certainty with what likelihood and to what extent they will be compensated in the event of an accident on the job. Thus the conventional economic view, predicated on the market determination of wages and working conditions, predicts that neither employers nor workers should care one way or another about the existence of the workers compensation system or the benefits it provides.
