To further add to the confusion, in the U.S. environmental regulations are enforced by the states, but only after the U.S. EPA approves each state s enforcement plan for consistency with the Federal program. States also can be more stringent than the Federal requirements. Thus, when the U.S. EPA decides to relax a requirement, states must act affirmatively to implement relaxed requirements.
