Safety enforcement

The responsibility for enforcing the legislation is in the main divided between HSE and the Lxx al Authorities Environmental Health Departments, depending largely on the nature of the work and the premises on which the work is being carried out. Note the Health and Safety (Enforcing Authority) Regulation 1989. 

To put it difTerently, governments in the EC and other countries have backed away from the direct command-and-control strategy of regulation, preferring to regulate (or, in the case of Japan, guide) the process of safety enforcement, which is delegated to the workers and firms directly concerned. 

But the corporate voice also requires some elements of safety enforcement at times, although this is often dressed in the clothes of safety propaganda, seeking to shift enforcement from the implementation of rules through punishment to the encouragement of individuals to follow the rules of their own volition. Regulatory enforcement actions are actions taken to deal with non-compliance by the operator with specified conditions and requirements. These actions are intended to modify or correct any aspect of an operator s procedures and practices or of a facility s SSCs as necessary to ensure safety. The Office of Price-Anderson Enforcement implements the congressionally mandated nuclear safety enforcement program in accordance with 10 CFR 820. The enforcement process provides fine mitigation for violations of nuclear safety requirements that are promptly reported to the Office of Enforcement and for which prompt corrective and effective actions are taken.

However, what is the biggest advantage of C in terms of run-time performance is also the biggest weakness for formal reasoning. The permissive memory access model of C, the lack of any reference safety enforcement, the weak type system and generally little semantic information in the code - all these properties do not allow to make many general assumptions about the code. 

The enforcement demarcation between HSE and Local Authorities (LAs) in respect of construction work is currently set out in the Health and Safety (Enforcing Authority) Regulations 1998, and in Regulations 3(4) and 22 of CDM 94. Interpretation of these requirements is not straightforward, but the practical effect is that LAs are currently prevented from enforcing CDM.
