Although the general pattern for the remediation process is for the enforcing authority to be under a duty to act, the legislation carefully moves to a power to take action—and is therefore discretionary—in circumstances where the burden of paying for the work falls on the enforcing authority. So in the fourth of the cases outlined above where a remediation notice cannot be served the enforcing authority acquires a power to carry out the remediation itself. [Pg.27]

The difference is not so much in the content of the registers—the consultation paper on the proposed Section 143 registers18 also proposed that information on actual risk assessment and remediation that had been carried out would be included on the register as well as earlier site history—but on the point in the assessment process at which the sites get recorded. Section 143 would have cut in early, leading to a large number of false positive identifications if the focus is only on current problem sites .
