Notices improvement

Having carried out an inspection of the works, the inspector has powers under Section 21 to serve an improvement notice if, in his opinion, a person is contravening one or more of the relevant statutory provisions, or has contravened one or more of those provisions in circumstances that make it likely that the contravention will continue or be repeated. The person concerned then has a duty to remedy the contravention or as the case may be, the matters occasioning it within such a period as may be specified in the notice. 

Issue an improvement notice if there is a legal contravention of any statutory legislation relevant to the activity in that the activity cannot be continued until the remedial action specified in the notice is implemented. This notice can be served on the person who is deemed to be contravening the legal provision or who is responsible for the activity, whether they are an employer, employee or a supplier of equipment or materials. 

What I ve found is this illness is cyclical. You might be in the depths of despair and illness one moment, but then the body does have an uncanny ability to repair itself, if not to recover fully, to at least improve noticeably. 

Of course, the problem in decay time measurements is improved noticeably if the noise level can be reduced. This is possible, but expensive. SPC instruments with peak counts of 500,000 have been developed. 59 ...

In addition to the three notices already promulgated, the Agency is planning future Label Improvement Notices on ingredients statements, analytical methods, eye irritation standards, antifouling paints, and farm worker safety. 

The different forms of sanctions, i.e. improvement notices, legal charges, administrative fines and guidelines - will dq>end on both the enterprise s actual working environment standards and on its own efforts. 

Enforcement powers. Compliance with OELs is a legal requirement under the COSHH Regulations. Under the HSW Act 1974 HSE inspectors have powers to issue two types of enforcement notice - an improvement notice or a prohibition notice - as well as powers to prosecute for criminal offences in the courts. Improvement notices are nomally used to instruct duty holders to remedy a situation in which an inspector believes that there has been a breach of the law resulting in a risk to the health or safety of persons that the law is intended to protect. The duty-holder is normally requir to remedy tiie situation within a specified time period in accordance wath the requirements laid out in the notice. Prohibition notices are normally issued where inspectors fell there is m imminent and serious risk to health and safety. They have the effect of prohibiting...

In 1990/91 a total of 2,518 improvement notices were issued under COSHH. Their annual number declined gradually during the 1990s to 1007 in 1999/00. In 1990/91 there were 136 prohibition notices issued. The niunbers issued over the next ten years fluctuated between 80 to 150 per year until 1996/97, but increased significantly after this time, reaching 278 by... 

An additional factor in the decline of improvement notices in the mid-1990s was the introduction of requirements on inspectors to issue a notice of intent before an improvement notice was issued. This may have had the effect of obviating the need to issue an improvement notice in some cases since duty-holders would have made the necessary improvements under the notice of intent. This requirement was removed in 1997. 

Although in comparison with improvement notices the number of prohibition notices issued under COSHH was relatively small, they increased in overall number during the 1990s and also therefore in proportion to improvement notices. The explanation for this is most likely to be the planned inspection activities of the FOD in particular industry sectors. Here, clear guidance would have been provided to inspectors on control standards and level of enforcement required, thus increasing their confidence to take this more serious enforcement action in circumstances in which it was felt to be warranted. 

Improvement notice — An inspector may serve ua improvement notice where s/he is of the opinion that a contravention of a statutory requirement has or is about to occur. It requires the person on whom the notice is served to make the necessary improvements to reach the desired standard. The inspector may specify appropriate remedial action and give a time limit of a maximum of 30 days in which to comply. 

An extension of a maximum of 10 days may be given if the time allowed in the first place is judged as insufficient. There is no appeal against the terms of the notice. Health and safety representatives should be given a copy of Improvement Notices. 

Let us note, that the Eq. (13) supposes the possibility of leaking coil realization (Z) =1.50 [10]) for all polymers. However, in the general case this does not occur. Therefore, if to assume, that for PAr F-1 and PS the state coil in good solvent with Z) =5/3 [10] is only attainable, then the first member in the equation (13) right-hand part should be replaced on 1.667 and in this case the correspondence will be improved noticeably. 

Cryptands have been somewhat deceptive for both coordination chemistry (Sastri et al., 2003) and photophysical properties of the resulting lanthanide complexes despite some commercial uses (Mathis, 1998), in particular of Lehn s Eu cryptate with cryptand 23a (fig. 28). The latter has been tested for the sensitization of the NIR luminescence of Nd and Yb. Characteristic emission from these two ions is seen upon excitation of the bipyridyl chro-mophores at 355 nm. Emission from Yb is reported to be much more intense than the one from Nd and the authors propose that the excitation mechanism depicted in fig. 9 is operative in this case since no transient absorption corresponding to the formation of the triplet state could be detected (Faulkner et al., 2001). Analysis of lifetime measurements in both water (r( F5/2) = 0.52 ps) and deuterated water (5.21 ps) gives a hydration number q = 1.5. Since fitting the luminescence decays to a double exponential function did not improve noticeably the resulting fit, the authors concluded that the non-integer value does not reflect an equilibrium between two different hydration states but, rather, that the distance of close approach of two water molecules is longer note that comparable experiments on Eu and Tb ...

For diamond wheels with mesh number finer than 4000 wheel, the roughness did not improve noticeably. 

After discussions and two night time visits from the factory inspector, the improvement notice was lifted when the port operator agreed to invest in high luminosity paint which does provide a benefit for the untrained eye, but as only appropriately trained people are allowed onto the dolphins it is of limited use. The port operator also undertook a trial using photoluminescent strips but this was ineffective, as there was so much background light in blackout conditions that it was impossible to see the strips glowing. 

Issue an improvement notice which will require an employer to put right, within a specified period of time, a minor infringement of the legislation.
