Regulation and Litigation

The HSA states, however, that "covered countermeasures" apply only to smallpox vaccines at this time, and although HSA protects manufacturers and others against liability, it does not directly set forth compensation procedures for vaccine recipients. Under Part C of the HSA, compensation for death benefits is capped at 262,100. If a case does end up in court, the plaintiff must "prove culpability equal to or rising above the level of negligence." It seems assured that the history of vaccine regulations and litigations will continue to change for some hme to come. Many companies and organizations have identified this inherent conflict and separated the workers compensation and safety functions. Although workers compensation is an individnal state program with individual state laws, regulations, and monetary payments, the workers compensation function can be an area of conflict as well as litigation in nnionized as well as nonunion operations. In unionized operations, workers compensation can also be a source of grievance by employees. The inherent conflict resnlting from workers compensation issues between the company and the employee or nnion can create barriers that can detrimentally affect the proactive efforts within the safety fnnction. 

As was pointed out above, it is evident that the new reliable and rapid analysis method for polymer additives is a challenging task for several reasons quality control, additive depletion/stability during processing and lifetime, litigation, migration studies, contamination, government regulations, and the development of new materials. 

Nearly every endeavor hinges on some aspect of the law. As a result, lawyers often become involved in safety and health matters, such as writing and interpreting laws, regulations and standards. Some deal with compensation for injuries, illnesses, and deaths or are involved in litigation related to safety of products and workplaces. 

Secondly, public acceptance of transport accidents as an inevitable price of mobility had been replaced by an unpreparedness to tolerate major accidents without recrimination, blame and litigation. Although the companies which caused accidents were mainly in the firing line, safety regulators did not escape scrutiny and units such as the HMRI began to be challenged over the closeness of their relations with the industry regulated and the lack of prosecutions initiated by them.
